هذا البحث في حكم إنشاء وإبقاء معابد غير المسلمين في ديار الإسلام وأحكامها تختلف، باختلاف أديانهم، وباختلاف الموقع الذي وجدت فيه والزمن الذي بنيت فيه وهي كثيرة جدا، ومن أشهرها الكنائس والصوامع، والبيع، والصلوات وبيوت النار، وكلها تعتبر بيوت كفر وضلال، وعلى هذا التقسيم لا يجوز إنشاء معابد لغير المسلمين في جزيرة العرب، ولا يجوز الإبقاء على ما كان موجودا فيها وأما دور عبادة الكفار الموجودة في البلاد التي فتحها المسلمون عنوة، فقد اختلف فيها والراجح جواز إبقائها، وأما إحداث معابد للكفار فيها فلا يجوز؛ لأنها صارت ملكا للمسلمين بالاستيلاء عليها، وكذا بناء كنائس في البلاد التي أنشأها المسلمون. وأما إذا صالح الإمام الكفار على أن الأرض لهم ولنا الخراج عنها، فإنها تكون دارهم دار عهد، فلا يتعرض لمعابدهم، ولهم إحداث ما يحتاجون من معابد، وإذا صالح الكفار على أن الدار للمسلمين، ويؤدون الجزية، فالحكم في البيع والكنائس على ما يقع عليه الصلح معهم، من إحداث ذلك وعمارته عدمه، وكل موضع أقر الكفار على معابدهم، لهم إعادة بنائها، وإصلاحها. ويجوز نقل معابد الكفار من مكانها إذا كان أصلح للمسلمين، بلا ريب؛ لأن هذا مصلحة ظاهرة للإسلام والمسلمين، فلا معنى للتوقف فيه، وأما إن كان النقل لمجرد منفعتهم، وليس للمسلمين فيه منفعة؛ فهذا لا يجوز. وإذا فتح المسلمون بلدا ووجدوا فيها مظاهر للشرك والكفر كالأصنام والأوثان، وكل ما يعبد من دون الله، فإنه يجب على الإمام، أو نائبه هدم وإزالة كل مظاهر الشرك والكفر، والذي يجب عليه هدمها وإزالتها، هو إمام المسلمين، حتى لا يترتب على ذلك مفاسد وفتن بين المسلمين، قد تكون أكبر من المصلحة التي يراد جلبها.

And if the infidels are reconciled to the fact that the house is for the Muslims, and they pay the tribute, then the ruling is in the sale and the churches on what is reconciled with them, from the effect of that, its construction and lack thereof, and every place the infidels approved of their temples, they have to rebuild them and revert what they are shaded and repair, and if the transfer of the temple From its place is better for Muslims, it is undoubtedly permissible , because this is an apparent interest for Islam and Muslims, so there is no point in stopping by it, but if the transfer is just for their benefit, and Muslims have no benefit in it. This is not permissible. And if Muslims conquer a country and find in it manifestations of polytheism and disbelief, such as idols and idols, and all that is worshiped besides God, then the imam or his deputy must demolish and remove all manifestations of polytheism and disbelief, and who must demolish and remove the signs of polytheism and disbelief, he is the imam of Muslims, even This does not result in evils and strife among Muslims, which may be greater than the interest that is sought to be brought.
