|a تركزت هذه الدراسة على بحث موضوع الحماية المدنية للرسوم والنماذج الصناعية وفق تحليل نصوص قانون الرسوم والنماذج الصناعية الأردني رقم (14) لسنة 2002، ونظام الرسوم والنماذج الصناعية الأردني رقم (52) لسنة 2002، واستندنا في هذه الدراسة إلى قانون المنافسة غير المشروعة والأسرار التجارية الأردني رقم (15) لسنة 2000، وتطرقنا إلى بعض النصوص من القانون المدني الأردني رقم (43) لسنة 1976 وتعديلاته. عالجت هذه الدراسة الحماية المدنية للرسوم والنماذج الصناعية في التشريعات الأردنية، حيث قام المشرع الأردني بسن قانون خاص بالرسوم والنماذج الصناعية، لكنه لم ينص صراحة على حمايتهما مدنيا عند التعرض لهما بأي صورة من صور الاعتداء، لكن يمكن للمدعى عليه أن يطالب بحقوقه من خلال دعوى المنافسة غير المشروعة عند الاعتداء على أيا منهما.
|b This study focused on examining the issue of civil Protection for industrial designs and models according to the analysis of the texts of the Jordanian Industrial Designs Law No. 14 of 2002 and the Jordanian Industrial Designs and Models Regulation No. 52 of 2002, and we based this study on the Jordanian Unlawful Competition and Trade Secrets Law No. 15 of 2000, and we touched on some texts from the Jordanian Civil Law No. 43 of 1976 and its amendments. This study dealt with the civil protection of industrial designs and models in accordance with Jordanian legislation, where the Jordanian legislator enacted a law on industrial designs and models, but did not explicitly provide for their civil protection when exposed to them in any form of abuse, but the defendant can claim his rights through a competition lawsuit. Illegal when assaulting either of them.
