|a تعد جرائم الفساد من الجرائم الخطيرة التي رأت غالبية التشريعات أن مكافحتها تستلزم سياسة جزائية ناجعة، لا ترتكز فقط على جانبي التجريم والعقاب، وإنما لا بد من تفعيل الدور السابق، وهو الجانب الوقائي، والمشرع الجزائر على غرار باقي التشريعات سعى إلى مكافحة جرائم الفساد بدأ من تكريس آليات وقائية شملت مختلف القطاعات التي مستها آفة الفساد. ونتيجة لتطور القطاع الخاص وما له من أهمية في الاقتصاد الوطني، قام المشرع بمكافحة الفساد داخله، وذلك حماية للمصالح الاقتصادية والاجتماعية التي تتعلق به نتيجة لتعاظم حجم مساهمة هذا النشاط في زيادة الإنتاج والنهوض بالاقتصاد الوطني، فلا يكفي التجريم والعقاب كآلية لاحقة وإنما لابد من آلية سابقة تساهم في كبح انتشار هذه الآفة."
