المستخلص: في ظل التقدم التقني والتكنولوجي في الوقت الحاضر، وفي إطار سياسة التحول الرقمي الذي تشهده المملكة لتحقيق رؤيتها الوطنية، حرص المنظم في المملكة العربية السعودية على السير نحو مواكبة هذا التطور التكنولوجي في جيع مرافق الدولة، ومنها: التعاقدات الإدارية، وخير شاهد على ذلك صدور نظام المنافسات والمشتريات الحكومية الجديد بموجب المرسوم الملكي رقم (م/١٢٨) 13/11/1440 ه، ولائحته التنفيذية المعدلة بموجب القرار الوزاري رقم (٢٤٧٩) وتاريخ 11/8/1441 ه، والذي استحدث أسلوب "المزايدة العكسية الإلكترونية" كأحد أساليب التعاقد مع جهة الإدارة، بما يتوافق مع متطلبات التحول الرقمي الذي تشهده المملكة؛ ولحداثة هذا الأسلوب الذي أتى وفق معطيات الواقع المعاش فإنه ما زال يفتقد إلى التطبيق العملي بوجود بعض الإشكاليات لدى المتعاقدين به وجهة الإدارة على حد سواء، ولأهمية هذا الأسلوب القصوى فقد حرصت على طرح هذه المسألة المستجدة لحداثتها؛ لبيان الغموض الذي يعتري ماهية أسلوب المزايدة العكسية الإلكترونية، وتحديد طبيعة هذا الأسلوب هل هو أسلوب شراء أو أسلوب بيع؟ وكيفية الإجراءات المتبعة في التعاقد به، وما القيود الواردة على سلطة الإدارة بإجراء المزايدة العكسية الإلكترونية؟ وقد خلصنا من هذه الدراسة إلى جملة من التوصيات، توصلنا فيها إلى مقترحات بتعديل بعض مواد النظام، وحلول يمكن من خلالها أن تسهم هذه الدراسة في خدمة الباحثين والمستشارين بشكل عام، وخدمة المتعاقدين مع جهة الإدارة بشكل خاص بما يتوافق مع المعطيات المعاصرة في ظل التقدم التقني المعاش.

In light of the technical and technological advancement at the present time, and within the framework of the digital transformation policy that the Kingdom is witnessing to achieve its national vision; The regulator in the Kingdom of Saudi Arabia was keen to move towards keeping pace with this technological development in all judicial facilities, including administrative contracts. The best evidence for this is the issuance of the new government tenders and procurement law under the Royal Decree No. (M
8) dated 13/11/1440H (16/07/2019), and its implementing regulations amended by the Ministerial Resolution No. 2479 dated 11/08/1441H (05/04/2020) which introduced the method of "electronic reverse bidding" as one of the methods of contracting with the administrative authority, in line with the requirements of digital transformation in the Kingdom. In view of the novelty of this method, which came according to the data of the reality, it still lacks practical application due to the existence of some problems for the contracting parties as well as the administrative authority. For the utmost importance of this method, I have been keen to raise this new issue because of its novelty to clarify the ambiguity about the entity of the method of electronic reverse bidding, and to determine the nature of this method. Is it a purchasing or a method of selling? What are the procedures to be followed in contracting through it? What are the restrictions on the authority of the administration to conduct the electronic reverse bidding? In this study, we have concluded a number of recommendations, in which we reached proposals to amend some of the articles of the law. We also found solutions through which this study can contribute to the service of researchers and consultants in general. It can serve the parties contracting with the administration in particular according to the contemporary data in the light of the modern technological advancement.
