|a إذا أنشأ التصرف القانوني صحيحا أو كان قابلا للإبطال ولم يطلب إبطاله، لا يعني أن آثاره تترتب من ذلك الحين بل إن آثاره تستقر فقط أو بتأييد وجوده بعد أن كان مهددا بالزوال، وترتيب الآثار يعني إنشاء التزامات على عاتق كل من طرفيه أو على عاتق أحدهما، بحسب ما إذا كان العقد من العقود الملزمة لجانبين أو من العقود الملزمة لجانب واحد. فمتى نشأ التصرف القانوني صحيحا، ترتبت عليه آثار من حيث إلزام المتعاقدين به باعتباره شريعة لهما، ومعنى ذلك أن كلا من المتعاقدين يلتزم بما يوجبه العقد كما لو كان ناشئا عن مصدر تشريعي. ثم إن التصرف بعد تسجيله يبقى كما كان قبل تسجيله، منشئا لالتزامات في جانب كلا الطرفين، وبالتبعية يستطيع كل طرف أو متعاقد أن يطالب الطرف الآخر بتنفيذ هذه الالتزامات المتقابلة.
|b The fact of making correct legal actions or cancelable ones that are not required to be canceled, doesn’t mean that it affects directly. It just settles down or supports its existence after being threatened with demise. All this results to some obligations for both contractors or for one of them depending on the type of the contract made. So, if we make a correct legal action, we will get effects that are obligations on contractors that again are legislation for them. This means that both of them are obliged to do what the contract says as if it is made from a legislation and any clause within the contract stays as it has been first when registered. Besides that each part of the contractors can ask the other to follow the clauses agreed on at the beginning.
