|a نص قانون الاستثمار لسنة 2016 في مادته 21 على ضمان المساواة بين المستثمرين قصد جلب أموالهم لاستثمارها في الجزائر بسبب أن مضمون هذا الضمان يقتضي ضرورة عدم إجراء أي مفاضلة بين المستثمر الوطني والأجنبي سواء من حيث المزايا الاقتصادية أو من حيث الالتزامات التعاقدية، لكن ما يلاحظ أن المناورات التشريعية وعصبية السيادة الوطنية قد تقيد صراحة هذا الضمان، وتقف حاجزا أمامه وهذا ما يؤدي إلى تجميد قواعد الحكامة الاقتصادية.
|b The purpose of this study is to high light the equality between investors, in order to bring their money to be invested in Algeria, according to the Law 16/09, Art. 21 related to Investment, stipulates an equitable treatment with regard to the rights and obligations attached to their investments. This guarantee requires the necessity of not making any trade- offs between the national and foreign investor. The legislative maneuvers and the fanaticism of national sovereignty may explicitly restrict this guarantee, and stand in the way of it, and this is what leads to the freezing of the rules of economic governance.
