المستخلص: تسعى الدراسة في إطار تفكيك العلاقة التي تجمع بين الإعلام والقضاء، إلى محاولة التعرف على الضوابط القانونية الخاصة بعملية نشر الصحفيين الجزائريين للأخبار المتعلقة بملفات التحقيق القضائي، في ظل التشريعات الإعلامية التي تعترف بحق الصحفيين في الحصول على المعلومات من المؤسسات القضائية "العمومية"، تجسيدا لحق أفراد المجتمع في الحصول على المعلومات القضائية للمتخاصمين والمتنازعين، لاسيما تلك التي تثير الجدل وتصنع الرأي العام، وأمام النصوص القضائية المنظمة لسير أجهزة العدالة والمتمثلة في قانون الإجراءات الجزائية وقانون العقوبات، التي تتشدد في سرية إجراءات التحقيق القضائي، يسعى أغلب الصحفيون بشتى الطرق والوسائل دون مراعاة شرعيتها في الحصول على بيانات وحقائق ملفات المتقاضين المتواجدة على مستوى مكتب قاضى التحقيق قصد نشرها للجمهور، ما يقد خلف أضرارا بليغة للأطراف المعنية بالملف القضائي.

This study seeks on devided under dismantling related and gathering between "Justic & Media", in order to try identifying and more knowledge "Legal Controls" spacialy on operation and processes publish on newspaper an Media, Algerian journalist in News and in information which related to "judicial Investigation files" under the legislation and laws of Media (common law of Media) which recognizes the Rights of journalists to obtain information from public judicial institutions embodying the rights of members of society to obtain judicial information for litigants and contestants especially those that give rise to controversy and Creat Public Opinion. So in this front of organized judicial texts to roul and walk a weel functioning of justice system which represented in the code of criminal procedure and penal cod with stronger secret judicial Investigation procedures, all the journalist's try and seek in various ways and means without observing their legitimacy in obtaining data and facts of the litigants so the files of the litigants located at all office is Investigation judge's office in order to publish them to public, as a results caused sever damage to the parties involved in the judicial file.
