In light of the increase in dealing with digital currencies, and in the absence of legal regulation of them, many issues arise related to those currencies, which need to be addressed, and among those issues is the inheritance of digital currencies after the death of their owners, as the special nature of those currencies that makes their possession is Intangible and tangible, in addition to the fact that the virtual currency, which is one of the types of digital currencies that is based on (coding), and is not subject to a central authority that supervises or monitors it, and is found in electronic wallets that can only be accessed by knowing its password. This would raise a problem about the possibility of the deceased's heirs obtaining these coins, especially if the inheritor did not inform them of the secret number through which they could be accessed, and if it could be inherited and transferred to the heirs after the death of the deceased, then how can the share of each heir of those coins be distributed And we have reached the conclusion that the absence of legal regulation of digital currencies in general, and the virtual cryptocurrency in particular, are among the reasons that lead to failure to transfer them to the heirs of the deceased owner of the currencies after his death, and this matter requires The need to provide legal and regulatory frameworks and provide all the requirements for dealing in digital currencies. Through the legislative treatment of these currencies, it becomes easy to inherit them. |
