المستخلص: يهدف هذا البحث إلى بيان مرتبة من مراتب التكليف التي تتعلق بالمكلف، وهي التكاليف البدلية، وقد عمدت فيه إلى بحث العلاقة بين التكاليف الأصلية والتكاليف البدلية، ومتى يخول للمكلف الانتقال من التكليف الأصلي إلى التكليف البدلي الذي هو تابع له وليس من جنسه، ولا في رتبته؟ مبرزا ما يفترق فيه التكليف البدلي عن الرخص الشرعية والذي قد يشتبه معناهما لما في كل منهما من الانتقال من تكليف إلى تكليف آخر، مثبتا أن التكاليف البدلية تختلف مراتبها من حيث التقسيم، وأن لانتقال المكلف من التكليف الأصلي إلى البدلي شروط يجب توافرها، وأن طريق ثبوت التكاليف البدلية النص والقياس الصحيح، وأن بطلان التكليف البدلي بعد تمكن المكلف من التكليف الأصلي له أحكام تتعدد بتعدد الأحوال، كما أن المكلف لا يزاد عليه في التكليف بأكثر مما جاءت به الشريعة، وقد أصلت لذلك تأصيلا أصوليا، مقربا بذلك ما استشكل من معانيه، موضحا كل هذا بالأمثلة، مدعما إياه بفروع فقهية متنوعة، والتي هي بمثابة جزء لا يتجزأ من فهم التكليف البدلي على حقيقته لدى الأصوليين والفقهاء.

This research aims to clarify the rank of the assignment ranks that are related to the person in charge , which are the alternative costs, and I have deliberately examined the relationship between the original costs and the alternative costs, and when the person in charge is authorized to move from the original assignment to the alternative assignment that is subordinate to him and not of his gender, nor in his rank ? Pointing out what separates the alternative assignment from the legitimate licenses, whose meaning may be suspected because of the transition from one assignment to another assignment, proving that the substitution costs differ in terms of division, and that the transition of the person in charge from the original assignment to the substitute has conditions that must be met, and that the way to prove text substitution costs and correct measurement, And that the invalidity of the alternative assignment after the person in charge was able to the original assignment has multiple provisions in multiple cases, and that the person in charge is not increased to him in the assignment by more than what was brought by the Sharia, and I have originally rooted for this, close to what has been formed from its meanings, explaining all this with examples, supporting it With various branches of jurisprudence, which is an integral part of the understanding of the substitutionary assignment as it is among the fundamentalists and jurists.
