المستخلص: ففي ظل المناشدات العالمية الصاخبة عبر منصات العالم المهتمة بقضايا حقوق الإنسان، والداعية إلى تطبيق الاتفاقات والمعاهدات الدولية بهذا الشأن، وتشدق الغرب بأنه راعي هذه الحقوق والحارس لها، وتصديق كثير من المسلمين وغيرهم لهذه الصيحات متناسين أن الدين الإسلامي هو السباق إلى حفظ هذه الحقوق حينما جاء بتشريعها، وكفل أسباب تطبيقها في الواقع وأن لا تكون مجرد شعارات براقة ليس لها في الواقع وجود، في ظل هذا كله أردت أن أسهم بعمل متواضع يجلي عظمة الإسلام وعنايته بالإنسان في جميع شؤونه وحفظه لحقوقه في كل زمان ومكان، ومن هؤلاء الذين ينادي الغرب بحفظ حقوقهم نزلاء السجون، وكنت كتبت بحثا حول حق المسجونين في النفقة فظهر لي جوانب مشرقة من عناية الإسلام بهم وحفظ حقوق كثيرة لهم مالية ومعنوية؛ فأردت أن أبين في هذا البحث ما يتعلق بجانب الحوق غير المالية (المعنوية) من خلال عرض مواقف الأنظمة الوضعية تجاهها ثم بيان سبق الشريعة الإسلامية لتقرير هذه الحقوق وعناية فقهاء المسلمين بها قديما وحديثا، وكان ذلك من خلال تمهيد وأربعة عشر مبحثا هي: يتكون هذا البحث من تمهيد وأحد عشر مبحثا، من أبرزها ما يلي: المبحث الأول: حق السجناء في فصلهم حسب المسجونين وأعمارهم وجرائمهم. والمبحث الثاني: حق السجين في الرعاية الصحية. والمبحث الثالث والرابع: حق السجين في أن يحبس في مكان صحي، وحق السجين في التعليم. والمبحث الخامس: حق السجين في الخروج لعيادة مريضه والصلاة عليه وتشييعه إذا مات. والمبحث السادس والسابع: حق السجين في إكرامه إذ مات في حبسه. وحق السجين في الخلوة بزوجته وتمكينه من وطئها. والمبحث الثامن: حق السجين في حضور جلسات محاكمته وسماع الدعوى وما إلى ذلك من أمور المحاكمة. والمبحث التاسع: حق السجين في التواصل مع السجناء في السجن وحقه في المشاركة في الشعائر الدينية

In light of the loud global appeals on the platforms of the world interested in human rights issues, and calling for the implementation of international agreements and treaties in this regard, and the West trumpets that it is the sponsor and guardian of these rights, and many Muslims and others endorse these cries, forgetting that the Islamic religion is the race to preserve these rights when it came By legislating it, and ensuring the reasons for its application in reality, and that it is not just shiny slogans that do not actually exist, in light of all this I wanted to contribute to a humble work that demonstrates the greatness of Islam and its care for people in all their affairs and their preservation of their rights in every time and place, and among those who call on the West to preserve their rights Prison inmates, and I wrote a research paper on the right of prisoners to alimony, so bright aspects of Islam’s care for them and the preservation of many rights for them, both financial and moral, appeared to me. The Islamic Sharia preceded to determine these rights and the attention of Muslim jurists in them, ancient and modern, and that was through a preface and fourteen chapters: The right of prisoners to be separated according to the prisoners, their ages, and their crimes. The second topic: the right of the prisoner to health care. The third and fourth topics: the right of the prisoner to be locked up in a healthy place, and the right of the prisoner to education. And the fifth topic: the right of the prisoner to go out to the clinic of his sick and to pray for him and to attend his funeral if he dies. And the sixth and seventh chapters: the right of the prisoner to honor him when he died in prison. The right of the prisoner to be alone with his wife and to enable him to have sexual intercourse with her. And the eighth topic: the right of the prisoner to attend his court sessions, hear the case, and other court matters. The ninth topic: The prisoner's right to communicate with prisoners in prison and his right to participate in religious rituals.
