المستخلص: لقد أدرك المجتمع الدولي أن المنظومة القانونية الدولية العامة عاجزة عن حماية حقوق الأشخاص ذوي الاحتياجات الخاصة أثناء النزاعات المسلحة، مما أدى به إلى اعتماد الاتفاقية الدولية لحقوق الأشخاص ذوي الإعاقة وبروتوكولها الاختياري، والتي جاءت للتأكيد على أن للأشخاص ذوي الإعاقة نفس الحقوق التي يتمتع بها الأشخاص العاديين خاصة في ظل الأزمات والكوارث التي يتعرض لها العالم وانتشار الأوبئة مثل (جائحة كورونا) مع إيرادها لبعض الحقوق الخاصة بهم كالحق في التأهيل وإعادة التأهيل. والحق في الصحة وعدم التعدي عليهم وعدم تجنيدهم للاشتراك في العمليات الحربية، ولضمان حماية هذه الحقوق، تضمنت هذه الاتفاقية واتفاقيات عالمية وإقليمية على آليات للحماية يمكن للأشخاص ذوي الإعاقة اللجوء إليها في حالة التعدي على أي حق من حقوقهم. هذه أهم المحاور التي تم تناولتها هذه الدراسة، والتي شملت الإقرار الدولي لحقوق الأشخاص ذوي الاحتياجات الخاصة، ثم الكلام عن آليات حماية حقوق الأشخاص ذوي الإعاقة أثناء النزاعات المسلحة، وأخيرا اختتمنا دراستنا ببعض النتائج والتوصيات لعل أهمها على الدول التي صادقت على الاتفاقية أن تعمل على جعل تشريعاتها متوائمة مع الاتفاقية. كما يجب أن تتضمن القرارات والتقارير المتعلقة بحالات النزاع وما بعد النزاع، بما في ذلك القرارات القطرية، تحليلا للعمر والجنس والإعاقة. عند تقديم التقارير، يجب تصنيف البيانات حسب العمر والجنس والإعاقة على الأقل للمساعدة في فهم احتياجات الحماية المختلفة للنساء والفتيات ذوات الإعاقة بشكل أفضل. وزيادة عمليات الرصد وتقديم تقارير مفصلة عن أوضاع الأشخاص ذوي الإعاقة في البلاد محل النزاعات المسلحة وأثناء الأزمات بصفة عامة، وذلك بموجب قرار مجلس الأمن الدولي رقم ٢٤٧٥. ونهيب بمجلس الأمن ضمان الحماية المتساوية للأشخاص ذوي الإعاقة وإدماجهم ومشاركتهم في تدابيره لاستعادة السلام والأمن الدوليين والحفاظ عليهما، على النحو الذي أوصى به المقرر الخاص وما ورد في قرار مجلس الأمن التابع للأمم المتحدة رقم ٢٤٧٥ لسنة ٢٠١٩. وكذلك تعزيز إدماج الأشخاص ذوي الإعاقة، على اختلاف نوع الإعاقة، في إدارة شؤون المخيمات وفي إعداد وتنفيذ ومراقبة برامج المساعدات. وإشراك المنظمات التي تمثلها الأشخاص ذوي الإعاقة في اليمن في البرامج الإنسانية.

The international community has realized that the general international legal system is unable to protect the rights of persons with disabilities during armed conflicts, which led to the adoption of the International Convention on the Rights of Persons with Disabilities and its Optional Protocol, which came to confirm that persons with disabilities have the same rights as ordinary persons. Especially in light of the crises and disasters that the world is exposed to and the spread of epidemics such as (the Corona pandemic) with its listing of some of their rights such as the right to rehabilitation and rehabilitation. Global and regional mechanisms for protection that persons with disabilities can resort to in the event of any violation of their rights. These are the most important axes that were addressed in this study, which included the international recognition of the rights of people with special needs, then talking about mechanisms for protecting the rights of people with disabilities during armed conflicts, and finally we concluded our study with some results and recommendations, perhaps the most important of which are the states that have ratified the Convention to work to make Its legislation is in line with the Convention. Resolutions and reports relating to conflict and post conflict situations, including country resolutions, must include an analysis of age, gender and disability. When reporting, data should be disaggregated at least by age, gender and disability to help better understand the different protection needs of women and girls with disabilities. Increasing monitoring and providing detailed reports on the situation of persons with disabilities in countries affected by armed conflicts and during crises in general, in accordance with UN Security Council Resolution No. 2475. We call upon the Security Council to ensure equal protection for persons with disabilities, their inclusion and participation in its measures to restore and maintain international peace and security, As recommended by the Special Rapporteur and the United Nations Security Council Resolution No. 2475 of 2019. As well as promoting the inclusion of persons with disabilities, regardless of type of disability, in the management of camp affairs and in the preparation, implementation and monitoring of aid programmers. Inclusion of organizations representing persons with disabilities in Yemen in humanitarian programmers.
