المستخلص: تأتي هذه الورقة البحثية لدراسة مسألة من المسائل الفقهية المهمة، التي اختلف في بيان حكمها العلماء، وأثارت جدلا واسعا بين العوام والدهماء؛ وهي مسألة: حكم صلاة المفترض خلف المتنفل. فتدرس هذه المحاولة المسألة في رحاب الفقه الإسلامي المقارن؛ وذلك بسرد الأقوال والأدلة في المسألة، ثم بيان أبرز المدافعات الواردة على هاذيك الاستدلالات؛ للخلوص إلى القول الراجح في المسألة. ولا تنعدم فائدة من خوض غمار هذه الجزئية؛ إذ أنها تأتي تأليفا للقلوب، وجمعا للكلمة، وطلبا لوحدة الصف؛ بعيدا عن التعصب المذموم لاجتهادات الأشخاص، وتحقيقا للتقارب المرغوب والتعايش المطلوب بين الآراء والمذاهب، كما كان من الأهداف المتوخاة: الدربة على صناعة العقل الفقهي الجسور، والذي لا يتحقق إلا من خلال الوقوف على أقوال الأئمة الفحول، والنظر في تراثهم الرصين.

This research paper comes to study one of the important doctrinal issues, which differed in the statement of the ruling of scholars, and sparked widespread controversy between the common people and the demagogues; And it is an issue: the ruling on a person who is obligated to pray behind the one who is performing the ritual prayer. This attempt studies the issue in the context of comparative Islamic jurisprudence. By listing the sayings and evidence in the matter, and then explaining the most prominent defenses of these inferences; To conclude the most correct opinion on the matter. There is no benefit in delving into this part; It comes as a synthesis of hearts, a plural of the word, and a request for class unity; Away from the blameworthy fanaticism of people’s jurisprudence, and to achieve the desired rapprochement and coexistence between opinions and sects, as one of the envisaged goals was: to be trained to craft a wise jurisprudential mind, which can only be achieved by standing on the sayings of the immoral imams, and looking into their sober heritage.
