|a للإنسان حقوق أخلاقية تنبع من إنسانيته، وتهدف إلى ضمان سلامته وكرامته الشخصية، يكفل حمايتها مجموعة من المبادئ القانونية العرفية والاتفاقية ممثلة في كل من القانون الدولي لحقوق الإنسان والقانون الدولي الإنساني، إذ حاولنا في دراستنا تحديد ماهية القانونيين وطبيعتهما وحدود نطاق كل منهما، فالأول يكفل الحقوق البشرية وقت السلم عموما، أما الثاني فيهدف إلى الحد من آثار النزاعات المسلحة لدوافع إنسانية، ويحمي الأشخاص الذين لا يشاركون في القتال أو كفوا عن المشاركة فيه، ولكلى القانونيين قواعد ذات طبيعة عرفية وقواعد ذات طبيعة تعاقدية، ملزمة للدول المشاركة في اتخاذها بصورة تعاقدية، وللدول غير المشاركة بصورة عرفية، هذان القانونان وإن كفلا حماية الإنسان من زاويتين مختلفتين فلا ينفي الواحد الآخر، بل يكمل أحدهما الآخر.
|b Human being have rights that derive from their humanity and aim to guarantee their personal safety and dignity, their protection is guaranteed by the international human rights law and international humanitarian law. we have tried in our study to define and determine the legal nature and scope of these latter, the first guarantees human rights in times of peace usually, and the second seeks to reduce the effects of armed conflict for humanitarian reasons, and protects people who are no longer taking part in the fighting, and there are rules of a customary nature and rules of a contractual manner, contractually binding on the signatory states, and for the other states in a customary manner, and even if its two branches guarantee human protection from two different angles without opposing each other, but rather they complement each other.
