|a هدفت هذه الدراسة للتعرف على الآثار القانونية للشائعة في القانون الأردني، وذلك من خلال مقدمة وثلاثة مباحث، استخدمت الدراسة المنهج الوصفي، كما استخدمت الدراسة المنهج الاستنباطي والمنهج الاستقرائي النظر في القوانين وآراء المشرعين، ومن أجل تحقيق أهداف الدراسة تم طرح الأسئلة الآتية: ما حقيقة الإشاعة؟ ومتى تقع المسؤولية الجنائية على الشخص بسبب ترويجه للإشاعة؟ وما الآثار القانونية الناجمة عن الإشاعة؟ وما الطبيعة القانونية لجريمة الإشاعة؟، حيث ضبط مشرع القانون مصطلح خطاب الكراهية الذي جاء بقانون العقوبات لعام 1960 وجرم نشر الإشاعات والأخبار الكاذبة بالحبس أو الغرامة، تتمثل السبل القانونية لمواجهة الإشاعة في الدور التشريعي، والدور الإعلامي، والتنظيمات السياسية، والمؤسسات التعليمية، ووزارة الأوقاف. وأظهرت نتائج الدراسة إلى أهمية تطبيق القانون في مواجهة الشائعات ولكن الخلاف يظهر في حجم هذا الدور وطبيعته إيجاباً وسلباً، ويعتبر مصطلح الإشاعة من المفاهيم ذات الدلالة الواسعة نظرا لاتصاله بتخصصات عديدة مثل علم النفس والقانون والأنثروبولوجيا والسياسة والاقتصاد والاجتماع والحرب النفسية وفي ضوء النتائج أوصت الدراسة بضرورة محاسبة كل من ينشر الشائعات أو من يسير في هذا الاتجاه من خلال القوانين الرادعة والضابطة.
|b This study aimed to identify the common legal effects in the Jordanian law, through an introduction and three topics, the study used the descriptive approach, the study also used the deductive approach and the inductive approach looking at laws and legislator’s opinions, and in order to achieve the goals of the study the following questions were asked: What is the truth of the rumor? And when does criminal responsibility fall on a person because he promotes the rumor? What are the legal implications of the rumor? What is the legal nature of the crime of rumor? Where the bill set the term of hate speech that came with the 1960 Penal Code and criminalized spreading false rumors and news with imprisonment or a fine., And that legal means to face rumors in the legislative role, the media role, political organizations, educational institutions and the Ministry of endowment. The results of the study showed the importance of applying the law in facing of rumors, but the difference appears in the size and nature of this role, positively and negatively .The term rumor is one of the concepts related to the wide-ranging activities because of its connection with many disciplines such as psychology, law, anthropology, politics, economics, sociology and psychological warfare. In light of the results, the study recommended that those who spread rumors or who go in this direction should be held accountable through deterrent and controlling laws.
