المستخلص: أدت ثورة الاتصالات والمعلومات والتطور التقني في استخدام الحاسب الآلي وشبكة الإنترنت إلى تطور كبير في التوقيع الإلكتروني الذي يستخدم في العقود الإلكترونية المبرمة عبر شبكة الإنترنت، فأصبحت معظم التعاملات تتم بواسطة الكتابة الإلكترونية والمحررات الإلكترونية، ويعتبر التوقيع الإلكتروني آلية لإثبات مختلف العقود خاصة منها عقود التجارة الإلكترونية، ونظرا لأهمية التوقيع الإلكتروني في الإثبات فقد بادرت مختلف التشريعات والقوانين الدولية والوطنية إلى تعريفه سواء في قوانين خاصة بالتجارة الإلكترونية، أو في قوانين متعلقة بالتوقيع الإلكتروني، وكذلك منحه نفس الحجية في الإثبات الممنوحة للتوقيع التقليدي. ولتحقيق التوقيع الإلكتروني لوظيفته وإضفاء الثقة والأمان للتعامل به وحمايته كان لابد من توفير آليات تضمن ذلك باستخدام تقنية التشفير، وكذلك بتدخل طرف ثالث في العلاقة التعاقدية المتمثلة في جهات التصديق الإلكتروني. ولذلك آثرت التعرض في المبحث الأول لبيان ماهية التوقيع الإلكتروني من حيث تعريف التوقيع الإلكتروني وصوره، وتناولنا في المبحث الثاني ماهية الكتابة والمحررات الإلكترونية. ومدى الحجية التي يتمتع بها في إطار عقود التجارة الإلكترونية وذلك في ظل الجهود الدولية والتشريعات المقارنة المنظمة للتوقيع الإلكتروني

The revolution of communication, information and technological development in the use of the computer and the Internet has led to a significant development in e-commerce transactions and e-signature, which is used in e-contracts concluded through the Internet. Most of the financial and commercial transactions are done by electronic writing and electronic editor. Which is compatible with the nature of legal actions and contracts that are made using modern technology. Therefore, electronic signature is considered a mechanism for proving various contracts, especially electronic commerce contracts The importance of the electronic signature in the evidence it has initiated various international and national legislation and laws to be defined both in electronic commerce, special laws, or related electronic signature laws, and also give him the same authentic proof granted traditional signature. To achieve the electronic signature of its function and to provide confidence and security to deal with it and protect it, it was necessary to provide mechanisms to ensure that using encryption technology as well as third party intervention in the contractual relationship of electronic certification. Therefore, the study deals with the electronic signature and its argument in proving the electronic commerce contracts and its enjoyment of the legal authority. Therefore, the exposure in the first part of the statement revealed the nature of the electronic signature in terms of definition and image of electronic signature. And the extent of its authenticity in the framework of e-commerce contracts, in light of international efforts and legislation governing the comparison of the electronic signature
