تهدف هذه الدراسة إلى بيان طبيعة أحكام السياسة الشرعية من حيث: مفهوم السياسة الشرعية، وأنواعها، وحجيتها، وأسسها، ووظيفتها، وخصائصها، ونماذجها المعاصرة، وذلك من خلال المنهج الاستقرائي والمنهج الوصفي التحليلي. وقد تناولت الدراسة جملة من الموضوعات من أبرزها: مفهوم السياسة الشرعية، وشروط إعمالها، ومجالاتها، وأنواعها، وحجيتها، وطبيعة أحكامها، ونماذجها المعاصرة. ومن أبرز ما توصلت إليه هذه الدراسة أن إعمال السياسة الشرعية لا يأتي اعتباطاً وإنما ينبغي أن ينضبط بضوابط وشروط معينة، وأن السياسة الشرعية هي السياسة العادلة، وأنها حجة معتبرة شرعاً بالأدلة المختلفة، وأنها تقوم على أصول الاجتهاد فيما لا نص فيه، كالاستحسان وسد الذرائع والمصالح المرسلة، وأن لها أهمية عظيمة ووظيفة هامة، وأنها غائية هادفة واقعية شاملة عادلة تقوم على أصول كلية راسخة، وأن أحكامها تنهض بها قيم عليا موضوعية توازن بين المصالح الضرورية والحاجية والتحسينية، وأنها وظيفية يجب أن تطبق في واقع الحياة، وبخاصة أن لها في الواقع العملي اليومي نماذج معاصرة بينة \
