المستخلص: يحتاج المقص في علوم الشريعة إلى تنمية ملكته عن طريق تتبع تأصيل الفقهاء للأحكام الشرعية، وبالتأمل في تحقيقهم المناط في آحاد الفروع تنمو للمتأمل منه تمكنه من التخريج والترجيح، وتهيئة للنظر في النوازل المتجددة. ومن أهم المصادر التي يستقى منها التأصيل لأحكام الشرع دواوين الفقه التي عني مصنفوها بالاستدلال والترجيح، ومنها: "كفاية النبيه في شرح التنبيه" للفقيه ابن الرفعة الشافعي، وقد خصت هذا البحث لذكر ما أودعه ‏في باب صفة القضاء" من القواعد الأصولية المتعلقة بمباحث الأخبار. ‏وقد اقتصر البحث في مقدمة، تضمنت: ذكر أهمية الموضوع، وسبب اختياره، ومنهج البحث، وتمهيد في مطلبين: ترجمت الشارح في أحدهما، وعرفت بمفردات العنوان في الآخر، وخمسة مباحث في كل مبحث مطلبان، ‏وخاتمة. ‏واستعملت المنهج الاستنباطي والاستنتاجي، فجمعت القواعد الأصولية الواردة في الباب المذكور، وأخضعتها للدراسة والتحليل. ومن نتائج البحث: أن "كفاية النبيه" من الشروح الفقهية المعتنية بالتقعيد والتأصيل، وقد احتوى على الكثير من أدلة الفقه الشافعي، وأن كثيرا من تأصيله ينقله ابن الرفعة عن الماوردي وإمام الحرمين، لكنه مص ناقد وأن تخريجه دقيق مستوف.

The practitioner of Sharia sciences needs to develop his faculties by following the rooting of the legal rulings by the jurists, and by meditating on their achievement entrusted to the individual branches, it grows for the contemplator, enabling him to graduate and weight, and prepare him to consider the renewed calamities. Among the most important sources from which the authentication of the rulings of Sharia is derived are the collections of jurisprudence whose authors are concerned with inference and weighting, including: Kefayat Al-Tanbah fi Sharh Al- Tanbah by the jurist Ibn Al-Rafa’ Al-Shafi’i. (Included mentioning the importance of the topic and the reason for choosing it, and the research method), and a preface in two demands, which the explainer translated in one of them, and defined the vocabulary of the title in the other, and five topics in each topic had two demands, and a conclusion. She used the deductive and deductive approach, so she collected the fundamentalist rules contained in the aforementioned chapter, and subjected them to study and analysis. One of the results of the research: that the adequacy of the prophet is one of the jurisprudential explanations concerned with the recitation and rooting, and that it contained a lot of evidence of Shafi’i jurisprudence, and that much of its rooting is transmitted by Ibn al-Rafa on the authority of al-Mawardi and the Imam of the Two Holy Mosques, but he is a critical scrutinize, and that his graduation is accurate and complete.
