المستخلص: A donation is a donation issued from two sides, which is held in accordance with the will of the donor and the gifted to him, and it is considered a dangerous behavior because it affects the financial responsibility of the donor, as it requires him to be slow and careful and take caution and caution before embarking on it, so that the donor puts his money in its proper place. If the gift contract fulfills its pillars and its conditions are fulfilled, its effects will arise, according to which the ownership of the gifted money is transferred from the donor to the one who is gifted to him, but it may happen that the donor retracts his gift for any reason, and disputes will result. How necessary is the donation contract? Is it permissible for the donor to return to it?

La donation est un acte de don émanant de deux parties, se conclut par l’accord des volontés du donateur et du donataire, et il considérer comme une action grave car il influe sur l’état financier du donateur, ce qui nécessite de sa part la sérénité et de la prévoyance avant son entame, ceci afin que le donateur met ses finances au bon endroit. Et si l’acte de donation réponde à ses conditions de formations, il produira ses effets, et la propriété de l’avoir donné du donateur au donataire est transférée. Toutefois il arrive que le donateur se rétracte sur sa donation pour n’importe quelle raison, ce qui induit des conflits. Quelle est la portée de l’obligation de l’acte de donation ? et est-il permis que s’opère une rétractation par le donateur?
