|a لقد أضحى العنصر البيئي اليوم بمثابة حقل تجارب ومحور لجملة من التدخلات والممارسات الإنسانية المختلفة، مما انعكس ذلك على كل المقومات البيئية والتأثير فيها بشكل جعل المهتمين يدقون ناقوس الخطر ويفكرون في إيجاد بدائل وسبل تكون كفيلة في تكريس حماية حقيقية للبيئة. وتعتبر الصفقات العمومية أحد أبرز الوسائل المتاحة والمساعدة في عملية تحقيق المصلحة العامة واحتياجات المواطنين من جهة، والماسة بالعنصر البيئي من جهة أخرى، كون أن إعمالها وتنفيذها لا يكون إلا على إطار الحيز البيئي وبوجود هذه العلاقة الحتمية بينهما بات لزاما تضمين نوع من الحماية للعنصر البيئي داخل بنود عقود الصفقات العمومية المختلفة حتى لا يتم المساس بها -أي البيئة- وبالتالي إبرازها كأحد المقاصد الواجب مراعاتها من قبل جل القائمين بالصفقات العمومية أثناء إبرام وتنفيذ هذه الأخيرة، وهذا ما سنبرزه من خلال هذه الورقة البحثية.

Public deals are considered one of the most prominent means available and help in the process of achieving the public interest and the needs of citizens on the one hand, and touching the environmental component on the other hand, since their implementation and implementation is only within the framework of the environmental space and in the presence of this inevitable relationship between them, it is imperative to include some kind of protection for the environmental component within The clauses of the various public procurement contracts so as not to be prejudiced - that is, the environment - and thus be highlighted as one of the purposes that must be taken into account by most of those involved in the public deals during the conclusion and implementation of the latter ،and this is what we will highlight through this research paper.
