|a تعتبر المضاربة أحد أهم آليات تنمية المال واستثماره في الشريعة الإسلامية، تقوم على شراكة بين أرباب المال وأصحاب الخبرات؛ وهذا ما يعد استثمارا مزدوجا للمال وللخبرات له أثره المالي والاقتصادي، اهتم بها الفقهاء وأصلوا أحكامها إلا أنها لم تأخذ حظها من التطبيقات المعاصرة، ولهذا جاء هذا البحث بغرض التنبيه إليها والتفصيل في طرق استثمار المال بها وبيان المتجدد من أحكامها، وقد برز من خلال البحث أنها بديل مهم لتمويل المشاريع تختلف عن أنواع التمويل الأخرى ندعو إلى اعتمادها في الجزائر في ضوء العودة إلى الصيرفة الإسلامية.
|b Mudaraba is one of the most important mechanisms for developing and investing money in Islamic law. It is based on the agreement of owners of money and experts. This is what is considered a double investment of money and expertise. which has a financial and economic impact. The jurists were interested in it and based its rulings accurately, but it did not take its share of contemporary applications, and for this reason this research came with the purpose of alerting to it and detailing the ways to invest money in it and a renewed statement of its provisions, and it has emerged through the research It is an important alternative to financing projects that differ from other types of financing. We call for its adoption in Algeria in light of the return to Islamic banking.
