المستخلص: إن الشريعة الإسلامية الغراء قد جمعت علوما متنوعة شتى: كالتفسير، والحديث، وعلم الكلام، والفقه وأصوله، وغيرها من العلوم، والذي برز من هذه العلوم كبروز الشمس في رابعة النهار هو علم الفقه؛ لأنه لا يستغنى عنه أي مسلم ومسلمة لارتباطه بالحياة اليومية، فهو علم يتناول ما يجب وما يندب وما يحرم وغيرها من الأحكام الشرعية، فجاءت أهميته لهذا السبب، لذا اهتم به الأولون رحمهم الله تعالى اهتماما كبيرا، منطلقين من قوله تعالى: "التَّائِبُونَ الْعَابِدُونَ الْحَامِدُونَ السَّائِحُونَ الرَّاكِعُونَ السَّاجِدُونَ الْآمِرُونَ بِالْمَعْرُوفِ وَالنَّاهُونَ عَنِ الْمُنكَرِ وَالْحَافِظُونَ لِحُدُودِ اللَّهِ ۗ وَبَشِّرِ الْمُؤْمِنِينَ"، فبينوا معظم المسائل الفقهية التي يحتاج إليها الناس. والناظر في هذا العلم يجد لعلمائه خلافات كثيرة في استنباط الأحكام من حيث الاختلاف في طريقة الاحتجاج بها أو من حيث اعتبار الفقيه لهذا المصدر أو ذاك حجة أو ليس بحجة، فنتج عن هذا الاختلاف مذاهب كثيرة منها ما بقيت إلى يومنا هذا ومنها ما اندثرت، فهو خلاف تنوع لا خلاف تضاد. وأن من نعم الله علي والتي لا تحصى أن من علي بحب متابعة آثار العلماء بما تركوه لنا من ثروة هائلة وتراث عظيم والنظر بعين الإجلال والتقدير إلى ما قدموه لنا من تحقيقات وإيضاحات لذلك الكنز الجسيم، ومن هنا عقدت العزم بعد التوكل على الله في أن يكون اختياري في موضوعات الفقه فوقع اختياري على كتاب ((خلاصة الدلائل في تنقيح المسائل في شرح القدوري، للإمام حسام الدين علي بن أحمد بن مكي الرازي ((ت 598ه))، مبينا فيه ترجيحات ذلك الإمام في بعض مسائل الجنايات. وقد اقتضت ضرورة البحث إلى تقسيمه على مقدمة وثلاث مباحث: أما المقدمة: فقد بينت فيها سبب اختياري للكتاب، والخطة التي سرت عليها في إعداد البحث. وتمحور المبحث الأول التعريف حسام الدين علي بن أحمد بن مكي الرازي وسيرته الذاتية والعلمية. أما المبحث الثاني تمحور حول دراسة الكتاب ومنهجه فيه. أما المبحث الثالث فقد تمحور حول بعض مسائل كتاب الجنايات دراسة مقارنة. وختمت البحث بأهم النتائج التي توصلت إليها. وفي الختام أسأل الله تعالى أن يقبل هذا العمل خالصا لوجهه الكريم وخدمة لدينه الحنيف، إنه أكرم مسؤول وخير مأمول، وآخر دعوانا أن الحمد لله رب العالمين.

It appeared in various types of sciences, jurisprudence, hadith, theology, jurisprudence and its origins, and other sciences, and this science is one of these sciences. Since it is indispensable for any Muslim about his daily affairs, he is aware of what he is and what surrounds him and what deprives him of the legal rules, so his importance came for this reason, the first in the mercy of God Almighty paid him attention to your belief, on the basis of the position of the Almighty: the repentant, the worshiper, the fervent, the fervent. Those who prostrate themselves, those who enjoin what is right and forbid what is wrong, and those who keep God’s limits ??? and those who seek to do what is right, so jurisprudential people need it. And in this science he finds for his scholars many differences in deducing the provisions and conditions in terms of the difference in the way they are invoked or in terms of his consideration of this source or that as an argument or not, with the pretext of diversity and no contradiction. And that God has blessed me with countless witnessing that he has given me the love of following the trails of scholars with what they left us of great wealth and a great heritage and looking with consideration and appreciation for what they gave us, and clarification of that, the great treasure, and from here the determination after relying on God that my choice should be subjects Jurisprudence, so I signed my choice on the book ((The Summary of Evidence in Revising the Interpretation of Al-Qudduri, by Imam Hussam Al-Din Ali bin Ahmed bin Makki Al-Razi ((d. 598 AH)), indicating the hope for this in some criminal matters. The introduction of the research necessitated dividing it into three sections: As for the previous version, in it I used an optional book and plan option Search setup. The first topic focused on introducing Hussam Al-Din Ali bin Ahmed bin Makki Al-Razi and his biography and science. The second topic focused on the study of the book and its approach. As for the third topic, it focused on some issues of the Book of Crimes, a comparative study. The research concluded with the most important findings. In conclusion, I ask God to accept this work, purely for his sake, traveling for his sake, and he is responsible and the best hoped, and our last prayer is that praise be to God, Lord of the worlds.
