المستخلص: تهدف الدراسة إلى التعرف على مذهب أهل السنة والجماعة في الخروج على الحاكم الكافر، وأيضا يتحدث عن الخلاف حول ولي الأمر الجائر. وسبب اختياري للدراسة بيان الرؤية الفقهية والأصولية المستندة إلى القرآن والسنة في مسألة الخروج على الحاكم، وتوضيح رأي أهل السنة والجماعة في تحريم الخروج على الحاكم المسلم، وتوضيح موقف السلف الصالح في هذه المسألة باعتبارهم خير القرون الإسلامية كما ذكر النبي عليه السلام، وإلى حل التعارض بين من قال بالخروج عبى الإمام، ومن منع ذلك، وفق قواعد أصولية ومقاصدية تؤكد مذهب أهل السنة والجماعة. ومن هنا تأتي أهمية الدراسة من حيث كونها دراسة شرعية فقهية وأصولية في تحليل مسألة الخروج على الحاكم، وبيان الاتجاهات الفقهية، والترجيح وفق علم الأصول والمقاصد، كي يكون المسلم على بينة من أمره في مسألة ذات صلة بالشأن العام، ولها أبعاد خطيرة على المجتمعات الإسلامية. وقد استخدمت منهجا وصفيا وتحليليا استدلاليا يقوم على: وصف القضية الفقهية، والاستدلال عليها بأدلتها من مظانها ومواردها الشرعية الفقهية والأصولية، ثم تحليلها وتفكيك أبعادها الشرعية والمعرفية؛ للخلوص إلى التقريرات الفقهية المستندة إلى المرجعية الشرعية. وقد خلصت الدراسة إلى جملة من النتائج منها: إجماع أهل السنة والجماعة على الخروج على الحاكم الكافر، واتفاق جمهور أهل السنة والجماعة على حرمة الخروج على الحاكم المسلم الجائر، وباستخدام قواعد العام والخاص، والنهي والأمر ترجح أحاديث المنع من الخروج على الحاكم، باستعمال قاعدة درء المفاسد وجلب المصالح وترجح قول المانعين للخروج، ومناصحة الولاة والإنكار عليهم تكون بالسر لا بالجهر، وهو الأصل في النصيحة عموما.

The study aims to identify the doctrine of the Sunnis and the group in revolting against the infidel ruler, and also talks about the dispute over the unjust guardian. The Muslim ruler, and clarifying the position of the righteous predecessors on this issue as they are the best of the Islamic centuries as mentioned by the Prophet, peace be upon him, and to resolve the conflict between those who said revolting against the imam, and those who prevented it, according to fundamentalist and intentional rules that confirm the doctrine of Ahlus-Sunnah wal-Jama’ah. Hence the importance of the study comes from As it is a study of legal jurisprudence and fundamentalism in the analysis of the issue of rebellion against the ruler, and the statement of jurisprudential trends, and weighting according to science The principles and purposes, in order for the Muslim to be aware of his affairs in an issue related to public affairs, and which has dangerous dimensions for Islamic societies. It has used a descriptive, analytical and inferential approach based on: describing the jurisprudential issue, and inferring it with its evidence from its sources and sources of jurisprudence and jurisprudence, then analyzing and deconstructing it its legal and cognitive dimensions; To conclude the jurisprudential reports based on the legal reference. The study concluded with a number of results, including: the unanimity of the Sunnis and the group to rebel against the infidel ruler, and the consensus of the majority of the Sunnis and the group on the prohibition of revolting against the unjust Muslim ruler, using the general and specific rules, and the prohibition and order. The rule of warding off evil and bringing benefits, and the preponderance of the sayings of those who prevent the exit, and advising the rulers and denial of them is done in secret and not out loud, which is the basis for advice in general.
