المستخلص: "لما كان الإمام الشافعي أول من ألف في علم أصول الفقه، ويرى بعض المتخصصين أنه مؤسس هذا العلم، كان البحث في منهجه في هذا العلم من خلال كتبه مهما؛ إذ يستطيع الباحث أن يجمع بين التأصيل والتطبيق، فقد كتب الشافعي الرسالة تأصيلا وتنظيرا مع شيء من التطبيق، وكتب الأم الذي يعتبر مرتعا خصبا للتطبيق واستنباط القواعد الأصولية، واكتشاف طريقته في الفقه والاجتهاد واستنباط الأحكام التي هي ثمرة علم أصول الفقه. ولما كانت الأدلة هي حقيقة علم الأصول وموضوعه، سواء الأدلة المتفق عليها، أو الأدلة المختلف فيها، اخترت أن أبحث في الأدلة المتفق عليها عند الإمام الشافعي، فكان هذا البحث المعنون بـ (قراءة أصولية في مباحث الأدلة المتفق عليها من كتاب الأم للشافعي، كتاب الصيام نموذجا)، وجاء هذا البحث مقسما على النحو التالي: التمهيد: في التعريف بالإمام الشافعي، وكتاب الأم. المبحث الأول: دليل القرآن الكريم. المبحث الثاني: دليل السنة النبوية. المبحث الثالث: دليل الإجماع. المبحث الرابع: دليل القياس. الخاتمة."

"Imam Ash-Shafe’i was the first to write books on the science of Fiqh (Islamic Jurisprudence) fundamentals. Some specialists even regard him as the founder of that discipline. That is why researching into Ash Shafe’i’s methodology in this particular science, through his own writings, is of paramount importance. In fact, such research can combine both theory and application. For example, Imam Ash-Shafe’i’s book, Ar Resalah الرسالة, comprises basic theories with some of their applications in the realm of Fiqh fundamentals. Moreover, his book Al-Umm الأم abounds in examples of the application of his theories and the deduction of fundamental Islamic rules. This research also investigates the method Imam Ash-Shafe’i adopts when it comes to Fiqh, Ijtihad (independent reasoning) and deducing rulings, which is the fruit of the science of Fiqh fundamentals. It is noteworthy that evidence is the very essence and main topic of Fiqh fundamentals science, be that evidence of consensus or controversial. Therefore, the research at hand explores the agreed-upon proofs provided by Imam Ash-Shafe’i; its topic is “A Fiqh Fundamentals Based Reading of the Questions of Agreed-upon Proofs from Ash Shafe’i’s Al-Umm: the Book of Fasting As a Model”. The research chapters are as follows: The Introduction: It introduces Imam Ash-Shafe’i and his Book, Al-Umm. Chapter One: Proofs from the Holy Qur’an. Chapter Two: Proofs from the Prophet’s Sunnah (i.e. Prophet Muhammad’s Sayings and Tradition). Chapter Three: Proofs of Consensus. Chapter Four: Proofs of Analogy. The Conclusion."
