|a تستعين هيئات الضبط الإداري لتحقيق أغراضها ببعض الوسائل والأساليب، حيث تلجأ إلى القرارات الضبطية التنظيمية أو القرارات الضبطية الفردية أو إلى التنفيذ المباشر أو إلى الجزاءات الإدارية وهو ما قامت به السطات الإدارية المركزية وأقصد بها الوزير الأول، وذلك باتخاذ تدابير إدارية متخذة للوقاية والحماية من جائحة كرونا، حيث اتسمت تلك التدابير بطابعها الضبطي الإداري الملزم ذي جزاءات إدارية وعقابية، كما أنها اتسمت بمسها بحقوق المواطنين وحرياتهم عن طريق الحجر الكلي والجزئي، وعليه تكمن أهمية هذا الموضوع في كونه يعد أحد مظاهر النشاط الإداري سواء على مستوى المركزي أو على مستوي المحلي، حيث يؤدي للمحافظة على امن وسلامة المجتمع خاصة في فترة انتشار جائحة كرونا وما ترتب عنها من إجراءات ضبطية صحية تمخض عنها الغلق التام والجزئي لبعض الولايات، حيث سنحاول في هذا المقال معالجة مشروعية هاته التدابير أي تدابير الضبط الإداري المتخذة في ظل وباء كرونا.

From the Corona pandemic, as these measures were characterized by their binding administrative control nature with administrative and punitive sanctions, as they were characterized by their infringement of the rights and freedoms of citizens through total and partial stone, Therefore, the importance of this topic lies in the fact that it is one of the manifestations of administrative activity, whether at the central level or at the local level, as it leads to maintaining the security and safety of society, especially during the period of the spread of the Corona pandemic and the consequent health control measures that resulted in the complete and partial closure of some states. We will try to address the legality of the administrative control measures taken in light of the Corona epidemic.
