|a إن التطور العلمي والتكنولوجي الرهيب الذي شهده العالم من ظهور للحواسيب والشبكات وغيرها، قد ساهم في نقل الملكية الفكرية بمفهومها الكلاسيكي إلى صورتها الحديثة والمتمثلة في الملكية الفكرية الرقمية وساهم في ظهور ما يسمى بالمصنفات الرقمية. إن حقوق الملكية الفكرية-وبالخصوص حقوق المؤلف -قد تأثرت بشكل سلبي بهذا التقدم التكنولوجي الحاصل على مستوى العالم، وذلك من خلال مختلف أشكال التعدي التي كانت مصاحبة له فانتشرت جريمة التقليد والقرصنة للملكية الفكرية في صورتها الرقمية بشكل واسع على مستوى دولي. وأمام هذه الاعتداءات المتكررة على المصنفات الرقمية وانتشارها على مستوى العالمي، فكان من الضروري أن يكون هناك اهتمام دولي جاد لحمايتها، وذلك من خلال إبرام العديد من الاتفاقيات والمعاهدات الدولية والرامية إلى حماية هذه الحقوق، فبرزت كل من اتفاقية الويبو WIPO أو ما يسمى باتفاقية الأنترنت الأولى، واتفاقية الجوانب المتصلة بالتجارة تريبس TRIPS وذلك من أجل حماية المصنفات الرقمية من جرائم التقليد. تهدف هذه الورقة البحثية إلى محاولة البحث عن حماية حقوق الملكية الفكرية في بيئتها الرقمية من جريمة التقليد كشكل من أشكال التعدي، ومحاولة إبراز أهم الاتفاقيات الدولية التي تصدت إلى هذه الاعتداءات، مع التطرق إلى تعريف المصنفات الرقمية وأنواعها والشروط الواجب توفرها من أجل حماية هذه المصنفات.
|b The terrible scientific and technological development that the world witnessed from the emergence of computers, networks and others, has contributed to the transfer of intellectual property in its classical concept to its modern form represented in digital intellectual property and contributed to the emergence of the so-called digital works. Intellectual property rights - and in particular copyright rights - have been negatively affected by this technological progress taking place in the world, through the various forms of infringement that were accompanying it, so the crime of counterfeiting and piracy of intellectual property in its digital form has spread widely on an international level. In the face of these repeated attacks on digital works and their spread on the global level, it was necessary to have serious international attention to protect them, through the conclusion of many international agreements and treaties aimed at protecting these rights, and the WIPO agreement or the so-called first Internet agreement emerged and TRIPS in order to protect digital works from counterfeiting crimes. This research paper aims to try to search for the protection of intellectual property rights in their digital environment from the crime of counterfeiting as a form of infringement, and to try to highlight the most important international agreements that addressed these attacks, with reference to the definition of digital works and their types and the conditions that must be met in order to protect these works.
