|a إن الأنظمة التنفيذية بوصفها قواعد عامة مجردة صادرة عن السلطة التنفيذية وفقا لأحكام القانون تطبق على طائفة معينة من الأفراد، فهي تخضع لرقابة القضاء الإداري ورقابة القضاء الدستوري، وذلك يشكل باعتقادنا ازدواجية في الرقابة، خاصة أن القضاء الدستوري عندما يفحص دستورية الأنظمة التنفيذية، فإنه يبحث في عيوب المشروعية القانونية، وهذا ما اتضح لنا من خلال الأحكام القضائية المفصلة في هذا البحث، وعلى هذا الأساس جاءت هذه الدراسة لتسليط الضوء على الموضوعات المتمثلة بماهية الأنظمة التنفيذية، بما في ذلك القوة القانونية لها، وهل تعد أعمالا تشريعية أم أنها لا تعدو أن تكون أعمالا إدارية؟ والكيفية التي يمارس فيها كل من القضاء الدستوري والقضاء الإداري لرقابتهما على مشروعية الأنظمة التنفيذية وصولا إلى حجية الحكم الصادر بنتيجة الرقابتين، وأثره، بهدف الوقوف على ما يعتري النصوص القانونية والأحكام القضائية الحديثة من قصور فيما يتعلق بموضوع الدراسة.
|b The executive regulations, as abstract general rules issued by the executive authority in accordance with the provisions of the law, are applied to a specific group of individuals, as they are subject to the control of the administrative jurisdiction as well as the control of the constitutional jurisdiction. We believe this has created a sense of duality through the special supervision and when the constitutional jurisdiction examines the constitutionality of executive regulations, it examines the defects in the legal legality of the jurisdictional laws. This was evident through the detailed judicial regulations in this research. On this basis, this study tries to shed light on the executive regulations, including their legal force, and whether they are considered legislative acts or just administrative acts. In addition to the manner in which both the constitutional jurisdiction and the administrative jurisdiction exercise their control over the legality of the executive regulations up to the authority of the sentence issued as a result of the two controls and its effect in order to determine the deficiencies in the legal texts and modern jurisdictional rulings with regard to the subject of the study.
