المستخلص: Moroccan waste law has established a set of legal instruments that are intended to be levers of sustainable development, including a system of control and punishment of offenses due to waste. Once in place, these instruments will enable waste management to be implemented without endangering human health and without harming the environment. However, beyond the sanctions adopted, the question of the effectiveness of the repressive regime arises acutely, hence the need for reflection in the quest for a third line of recourse between prevention and repression, a guarantee of an effectiveness of the Law of waste.

Le droit marocain des déchets a érigé un ensemble d’instruments juridiques qui ont pour vocation d’être des leviers de développement durable, dont un système de contrôle et de répression des infractions du fait des déchets. Une fois mis en place, ces instrumentsvont permettre d’instaurer une gestion des déchets sans mettre en péril la santé humaine et sans nuire à l’environnement. Cependant, au-delà des sanctions adoptées, la question de l’efficacité du régime répressif se pose avec acuité, d’où la nécessité à une réflexion à la quête d’une troisième voie de recours entre prévention et répression, gage d’une effectivité du Droit des déchets.
