تمثل مرتبة التحسينات واحدة من مراتب مقاصد الشريعة التي تتابعت عبارات الأصوليين على تقريرها وإثباتها والتأكيد عليها، وقد تناولت هذه الدراسة حقيقة هذه المرتبة وأهميتها وعلاقتها بكل من مرتبتي الضروريات والحاجيات، كما بيَّنت الأحكام التكليفية التي تتعلق بالأفعال المنتظمة في سلك هذه المرتبة من حيث الوجوب والندب والكراهة والتحريم والإباحة. وأكدّت الدراسة على أن المصالح التحسينية هي مصالح كلية مطردة في جميع أبواب الشريعة وموضوعاتها، وأنها مصالح معتبرة يؤدي التفريط بها أو إهمالها بالكلية إلى إدخال النقص على المصالح الأولى منها في المكانة والرتبة والاعتبار، وأن الحفاظ على الضروريات والحاجيات يستدعي الحفاظ على التحسينات أيضاً، وخلصت الدراسة في موضوع حجية المصالح التحسينية إلى أنه لا يشترط في المصلحة المرسلة حتى يؤخذ بها أن تكون ضرورية أو حاجية ، ذلك أن كل مصلحة قد شهد الشارع لجنسها بالاعتبار، وكانت ملائمة لمقصود الشارع فهي مصلحة معتبرة، سواء أكانت ضرورية أم حاجية أم تحسينية.
The class of ameliorations represents one of the basic classes within the intents of Sharia.> This study investigates the class of ameliorations, its importance, and its relation to the class of necessities and to the class of needs. The study illustrates the rulings related to the regular actions within class of ameliorations from the points of the action being obligatory, recommended, allowed, not recommended, or prohibited. The study demonstrates that ameliorative rulings are universal and are present in all sections of Islamic Sharia law. Ignoring and abandoning ameliorative interests adversely influences other interests of higher importance. The sustainment of the interests in the class of needs or in the class of necessities mandates the sustainment of the interests within the class of ameliorations as well. Within the arguments for ameliorative interests, the study concludes that it is not necessary for the interest to be a needed or a necessary interest in order for it to be taken into consideration. That is, each interest of the type credited by the legislator, and was in harmony with the intent of the legislator is a considered interest.
