تهدف هذه الدراسة إلى بيان الرأي الراجح في حكم وقوع الطلاق بلفظ عليّ الطلاق وعليّ الحرام وأثره في الفقه الإسلامي من خلال المنهج الاستقرائي والمنهج الوصفي التحليلي، حيث عمد الباحث إلى ذكر آراء الفقهاء وأدلتهم ومناقشتها لبيان الرأي الراجح. وقد تناولت هذه الدراسة تحرير محل النزاع، وآراء الفقهاء، وسبب اختلافهم، وأدلتهم، ومناقشاتها، والراجح منها، والآثار المترتبة عليها، فضلاً عن أنها تناولت رأي قوانين الأحوال الشخصية العربية في المسألة. ومن أبرز ما توصلت إليه الدراسة: عدم وقوع الطلاق بلفظ عليّ الطلاق، وعليّ الحرام؛ لأسباب عدة ذكرها الباحث في الرأي الراجح. ويوصي الباحث بضرورة أن تعيد قوانين الأحوال الشخصية العربية التي تقول بوقوع الطلاق بلفظ عليّ الطلاق وعليّ الحرام، النظر في هذا الرأي والأخذ بالقول بعدم وقوع الطلاق؛ رعاية لتماسك الأسر وحفاظاً عليها من التفكك.
This study aims to correct a statement of opinion in the governance of a divorce and the word on the no man's land and their impact on Islamic jurisprudence through the inductive approach and the descriptive analytical method, where the researcher deliberately discusses the views of scholars and their evidence, and presents the correct opinion . This study has been editor in dispute the views of scholars, the reason for their differences, their evidence, debates. The study also presents implications, as well as it dealt with the view of Arab personal status laws in the matter. The study concludes that: the lack of a divorce on the word divorce, and on no man's land; for several reasons mentioned by the researcher. The researcher recommends the need to restore Arab personal status laws, which stale the wording on the occurrence of divorce and divorce on the land, consider this opinion and the introduction by saying there would be no divorce, and care for the cohesion of families and to preserve it from disintegration.
