|a تعد أضرار التلوث البيئي من أخطر واعقد ما يؤرق استقرار العالم، وهذه الأضرار قد تفاقمت حديثا بعد التطور الهائل في الصناعة وما صاحبه من إطلاق كميات هائلة من النفايات والفضلات ذات خصائص وصفات ومصادر متنوعة في البيئات المختلفة، بحيث لا بد من التصدي إليها ووضع الحلول لها، من خلال تكافل وتتضافر الدول للحد من مخاطرها، وتقرير المسؤولية والجزاء المناسبي، فضلا عن تأمين الوقاية المناسبة لكل متضرر. وقد تناولنا فيها البحث الأساس القانوني للمسؤولية الدولية عن المساس بالبيئة، وبيان جزاء المسؤولية المتربية على ذلك حال تحققها. وقد خرجت هذه الدراسة بعدد من النتائج والتوصيات أهمها: عدم كفاية النصوص القانونية والأحكام القضائية المتعلقة بالمسؤولية الدولية عن الأضرار البيئية في القانون الدولي العام. فإذا كان الالتزام بالمحافظة على البيئة أصبح أمرا لا يثير خلافا في النظم القانونية الوطنية، فالأمر ليس كذلك في القانون الدولي، ومن أهم التوصيات أن تستكمل الأمم المتحدة دورها في حماية البيئة من التلوث، من خلال وضع قوانين تلزم كافة دول العالم باحترام البيئة ومعاقبة كل من يتسبب بتلوث بيئي.
|b International responsibility for environmental pollution damages The damages of environmental pollution are one of the most dangerous and complicate that disturbs the stability of the world, and these damages have recently aggravated after the tremendous development in the industry and the accompanying release of huge quantities of waste and junk with diverse characteristics, qualities and sources in different environments, so that it is necessary to address them and develop solutions Through the solidarity and concertedness of countries to reduce their risks, and to determine the appropriate responsibility and sanction, as well as to ensure appropriate prevention for each affected person. In this research, we discussed the legal basis for the international responsibility for violating the environment, and the sanction of the resulting liability if it is happening. This study came out with several results and recommendations, the most important of which are: the insufficiency of legal texts and judicial articles related to international responsibility for environmental damage in public international law. If the obligation to protect the environment has become a matter that does not raise a controversy in the national legal systems, it is not the case in international law, One of the most important recommendations is for the United Nations to complete its role in protecting the environment from pollution, by establishing laws that obligate all countries of the world to respect the environment and to punish anyone who causes environmental pollution.
