الحديث عن الفساد يتخذ العديد من الاتجاهات وذلك بسبب تنوع أشكال الفساد وتنوع ثقافة الشعوب، فمفهوم الفساد في العالم العربي ليس كمفهوم الفساد في المجتمع الأوروبي، إلى أن هذا لا ينفي اتفاق جميع المفاهيم على أن هناك تدني كبير في مستوى الأخلاق الذي أدى لبروز مثل هذه الظاهرة. ففي المجتمعات العربية الإسلامية خاصة وبالرغم من أن الدين الإسلامي يحرم الفساد تحريم مطلق والآية الدالة على ذلك عديدة ووضحت أشد الوضوح، إلا أن الأفراد لم يرتدعوا وذلك ما أوجب التعامل مع الظاهرة بوضع مجموعة من القوانين والبرامج التي تكفل احتوائها ومن ثم معالجتها، لذلك تم إقامة ما يعرف بالمنظمة العربية لمكافحة الفساد والتي تقوم بجمع ودراسة ومراقبة المعلومات المتعلقة بالفساد في الحياة العامة من مختلف المصادر المتوفرة كما تقوم بإصدار تقارير دورية عن المستوى الذي وصل إليه الفساد داخل الدول المصادقة على الاتفاقية المنشئة للمنظمة، وكذلك تقوم بدراسات شاملة حول القوانين والإجراءات المتبعة في الدول العربية، والتي لها علاقة بالفساد، واقتراح أية تعديلات إيجابية عليها. إلا أن فاعلية المنظمة والقوانين التي قامت بوضعها الدول العربية والتي تتماشى مع ما طلبته المنظمة العربية لمكافحة الفساد، لم تتعدى الحبر على ورق لأن مشاريع القوانين الموضوعة لم تكن مستندة لآراء القضاة والمحامين المحترمين والنخب المجتمعية لأن هؤلاء هم الأعلم بما يجري في دهاليز التنظيمات الإجرامية الاقتصادية. إن الهدف من تقديم هذا البحث ليس تقديم مفاهيم فقط حول ما يعنيه الفساد في العالم العربي وغيره من المجتمعات، ولا التعرف على الأسباب الاجتماعية والاقتصادية التي أوجدت هذه الظاهرة، بل سنركز الضوء كذلك على جرائم الفساد التي حدثت في مجموعة من الدول العربية، وهل تم توقيع الجزاء اللازم على المرتكبين لهذه الجرائم ليكونوا عبرة لغيرهم.

Especially in Arab-Muslim societies, Although the Islamic religion absolutely prohibits corruption And the verse is indicative of this many and clarified more clearly, However, individuals have not been deterred and this has compelled to deal with this phenomenon by developing a set of laws and programs to ensure its containment and then address, Therefore has been founded the Arab Anti-Corruption Organization, It collects, studies and monitors information related to corruption in public life from various available sources, It also publishes periodic reports on the level of corruption within countries ratifying the convention establishing the organization, It also conducts comprehensive studies on laws and procedures in the Arab countries related to corruption, and proposes any positive amendments to them. However, the effectiveness of the organization and the laws developed by the Arab countries are in line with the demands of the Arab Anti Corruption Organization, they did not exceed the ink on paper because the draft laws were not based on the opinions of judges, respected lawyers and community elites, because these are the most aware of what is happening in the corridors of economic criminal organizations. The aim of this research is not to present only concepts about what corruption means in the Arab world, and other societies, and do not identify the social and economic causes that created this phenomenon, We will also focus on corruption crimes that have taken place in a number of Arab countries, and Have the perpetrators of these crimes been punished to serve as a lesson to others?
