سلطت الدراسة الضوء على أثر النية في استباحة رخص السفر، فلما كانت النية هي أساس قبول العمل عند الله -سبحانه وتعالى-، جاء هذا البحث هادفا لبيان الأحكام المتعلقة بأثر النية في استباحة رخص السفر، مبينا أثر النية المجردة عن الشروع في السفر في استباحة رخصه، وأثر النية في قصد المكان بأن كان مستقلا برأيه أو تابعا، وأثر النية في قصد الطريق بمنظور العذر وعدمه، وتعدد نية المسافر، وحال كونه عاصيا، أو كونه مقيما، وأثر ذلك في استباحة رخص السفر. حيث خلصت الدراسة إلى اعتبار النية مما ترتب عليه عدم استباحة رخص السفر، ومن لم ير اعتبارا للنية أجاز ذلك، وإن اختلفت أنظار الفقهاء للنية في مواطن، فعدم اعتبار النية ترتب عليه جواز استباحة رخص السفر خلافا لمن اعتبرها.
The study sheds light on the effect of Niyah (Intention) in permitting travel licenses. As Niyah is the basis for acceptance of an act (of worship) by Allah (Subhanahu was Ta’ala), the purpose of this research is to show the rules arising as a result of the effect of Niyah (Intention) in permitting travel licenses indicating the effect of the mere intention of embarking on travel in permitting his licenses, and effect of the intention on intending the place by whether it is independent or dependent, and the effect of the intention on intending the road in terms of excuse or not, and the multiplicity of the traveler's intention, and the of being disobedient, or is a resident, and the effect of that on permitting travel where study concluded that intent is considered, which resulted in not permitting travel licenses. and whoever does not the intention consideration to the intention permitted he authorized it, and if the eyes of the jurists differed for the intention in a citizen, then not considering the intention resulted in permitting the permissibility of travel permits contrary to those who considered them.
