|a تتمحور هذه الدراسة حول مدى اختصاص القضاء الدستوري ممثلا بالمحاكم والمجالس الدستورية في الرقابة القضائية على التعديلات الدستورية، حيث يوجد هناك اختلاف في موقف دساتير الدول اتجاه مسألة رقابة التعديلات الدستورية، كذلك نطاق هذه الرقابة أيا كان نوعها وشكلها إلا أنها تشمل الرقابة القضائية على القيود الشكلية والموضوعية معا حيث اختلفت الدساتير في موقفها من رقابة هذه القيود. وعليه فإن هذه المسألة تثير عدة إشكالات وصعوبات قانونية قد تواجه القاضي الدستوري، فلا بد من معرفتها للوصول إلى سبل تفعيل التعديل الدستوري من جانبه الرقابي سواء من الناحية الموضوعية أو الإجرائية.
|b This study revolves around the extent of the jurisdiction of the constitutional judiciary represented by the courts and constitutional councils in judicial oversight of constitutional amendments, where there is a difference in the position of state constitutions regarding the issue of oversight of constitutional amendments, as well as the scope of this oversight, whatever its type and form, to include judicial oversight of formal and substantive restrictions However, the constitutions differed in their stance on the control of these restrictions. Accordingly, this issue raises several legal problems and difficulties that may face the constitutional judge, it must be known to reach ways to activate the constitutional amendment from its supervisory side, whether in substantive or procedural terms.
