يهدف هذا البحث إلى بيان أثر المقاصد الشرعية في القواعد الفقهية عند المالكية، وذلك من خلال بيان كيفية تأثر القواعد الفقهية بالمقاصد الشرعية، فالقواعد الفقهية بنيت على مقاصد الشريعة الإسلامية وتأثرت بها. وقد قسمت هذا البحث إلى مقدمة وخمسة مباحث وخاتمة، فذكرت في المبحث الأول تعريف المقاصد والقواعد الفقهية، ثم ذكرت في المبحث الثاني الفرق بين القواعد الفقهية والمقاصد الشرعية والأمور المشتركة بينهما، وأما المبحث الثالث فذكرت فيه أقسام المقاصد وأثر هذه الأقسام على القواعد الفقهية، وذكرت في المبحث الرابع اهتمام المالكية بالمقاصد من خلال أصولهم وأقوال إمام المذهب وكذلك أقوال المذهب، ثم بينت في المبحث الخامس مدى تأثر القواعد الفقهية بالمقاصد الشرعية عند المالكية. وتوصلت في نهاية هذا البحث إلى عدة نتائج منها: أن المقاصد الشرعية هي الأساس في تكوين القواعد الفقهية، وأنها أثرت في توسع فقهاء المالكية في بعض القواعد الفقهية مما جعلهم ينفردون ببعض الفروع الفقهية عن المذاهب الأخرى، كما أنها تؤثر أحيانا في بعض القواعد الفقهية بحصول بعض الاستثناءات فيها، وتخصص بعض عمومياتها، وأنها ترجح الخلاف الحاصل في بعض القواعد الفقهية الصغرى.
This study aims at demonstrating the impact of the Sharia objectives on the jurisprudential rules of the Maliki thought, by clarifying the impact of the Sharia objectives on the jurisprudential rules, as the jurisprudential rules are based on the Sharia objectives and are affected by them. I divided this research into an introduction, five chapters and a conclusion. In the first section I mentioned the definition of the objectives and the rules of jurisprudence, then in the second topic I mentioned the relationship between the objectives of Sharia and the rules of jurisprudence, and in the third section I mentioned the sections of the objectives and the effect of these sections on the rules of jurisprudence, and I mentioned in the third topic the interest The Malikis have the objectives of Sharia through their origins and the sayings of the Imam of the sect, as well as the sayings of the doctrine. Then, in the fifth study, it showed the extent to which the jurisprudential rules are affected by the aims of Sharia. At the end of this research, I concluded several results, including: that the Sharia objectives are the basis for the formation of the jurisprudential rules, and that they have affected the expansion of the jurists of the Maliki thought of jurisprudence in some of the rules of jurisprudence, which made them separate some branches of jurisprudence from other schools of thought, and occasionally affecting some jurisprudential rules by some exceptions, specialization of some of its generalities, and it favors the dispute in some minor jurisprudential rules.
