Liberalization of trade in services is an unavoidable condition for the FDI promotion, and the GATS goes in this liberal direction and provides a multilateral framework of binding and enforceable rules and principles on measures affecting foreign investments. This paper first introduces FDI in services by highlighting its economic and social importance before turning to the question of the definition of services and international trade in services under the GATS, and then examining, in a second part, the general framework of the GATS by outlining, on one hand, the general obligations and disciplines that apply directly and automatically to all member states, and the conditional obligations that depend on specific commitments, on the other. This is to try to show how the GATS could contribute to improving access to foreign markets and thus promote FDI. La libéralisation du commerce des services est une condition sine qua none pour la promotion des IDE, l’AGCS, s’inscrit dans cette direction libérale et offre un cadre multilatéral de règles, de principes contraignants et exécutoires concernant les mesures affectant les investissements étrangers. Cet article présente de prime abord, les IDE dans le secteur des services en mettant en exergue leur importance économique et sociale avant de s’intéresser à la question relative à la définition des services et du commerce international des services selon l’AGCS, pour examiner, ensuite, dans une deuxième partie le cadre général de l’AGCS en exposant, d’une part, les obligations et les disciplines générales qui s’appliquent directement et automatiquement à tous les Etats membres , et les obligations conditionnelles qui dépendent des engagements spécifiques, d’autre part. Ceci pour tenter de monter comment l’AGCS pourrait-il contribuer à améliorer l’accès aux marchés étrangers et promouvoir ainsi les IDE ? |
