المستخلص: يعتبر تعريف كل من مفهوم اللجوء والهجرة غير الشرعية والمهاجرين أمرا معقدا خصوصا إذا ما تعلق الأمر بالقاصرين الذين قلما نشهد ورود لفظتهم في القوانين والاتفاقيات المتعلقة بالهجرة واللجوء. في هذا الصدد، طرحنا في المقالة التالية الإشكالية لمعرفة إلى أي حد يختلف مدلول اللجوء عند القاصر عن مفهوم المهاجر القاصر، وما مدى إمكانية الجمع بينهما باعتماد الخصائص المشتركة بينهما. وللإجابة على هذه الإشكالية، تطرقنا في بادئ الأمر إلى مفهوم الحق في اللجوء عند القاصرين حيث ميزنا بين مختلف تعاريف اللاجئ القاصر التي عزت جميعها السبب الرئيسي وراء الهروب من الاضطهاد في الوطن الأم دونما تعريف للاجئ، ومن تم بينا أوجه الاختلاف والتقارب بينه وبين مفهوم المهاجر القاصر باعتماد المنهج الكمي لتجميع المعلومات والنصوص والدراسات وتحليلها في أفق توظيفها، إلى جانب المنهج الكيفي لرصد مؤشرات التحليل المعتمد في هذه المقالة.

It is undeniable that the definition of asylum and illegal migration remains a difficult and complex task, especially when it comes to minors. It is unusual for the concept of minors to be found in conventions and laws relating to asylum and illegal migration, This is what has challenged us in order to raise the problem of the dichotomy between the two concepts and their potential convergences at the level of this article. In order to respond to this problem, we considered it appropriate to define the concept of the right of asylum for minors by distinguishing the different definitions of the minor refugee, who agree that persecution is the main reason for leaving the country of origin without defining the refugee. In addition, the collection of information and the analysis of the texts and documentation in question were carried out using the quantitative approach to collect and analyse information.

Il est indéniablement admis que la définition des concepts d’asile et de migration illégale demeure tâche rude et complexe, surtout lorsqu’il est question des mineurs. En effet, il est peu courant que l’on retrouve la notion de mineurs dans les conventions et lois relatives à l’asile et à la migration illégale, ce qui nous a i interpellé pour soulever la problématique relative à dichotomie entre les deux notions et leurs convergences potentiels au niveau du présent article. Afin de répondre à cette problématique, nous avons jugé convenable de définir le concept de droit d’asile pour les mineurs et ce, en distinguant les différentes définitions du réfugié mineur, qui s’accordent sur la persécution comme raison principale de quitter le pays d’origine sans pour autant définir le réfugié. Par ailleurs la collecte d’information et l’analyse des textes et documentation en question ont été faites en adoptant l'approche quantitative pour collecter et analyser des informations, puis l'approche qualitative pour suivre les indicateurs d'analyse adoptés dans cet article.
