المستخلص: لقد تناول هذا البحث ماهية الجينات الوراثية ومدي أهميتها، إذ إنها هي المسئولة عن نقل الصفات الوراثية الخاصة بالفرد من جيل إلى آخر. حيث أن الجين يقوم بحمل المعلومات والصفات الوراثية كما أنه يتحكم في ترجمتها أيضا والتعبير عنها، فضلا عن أنها لها أهمية كبيرة في تحديد الصفات الوراثية للإنسان وكذا التنبؤ بالأمراض التي قد تصيب الإنسان مستقبلا وكذا التعرف على مرتكبي الجرائم وإثبات النسب أيضا وذلك عن طريق اختبار البصمة الوراثية. كما تم التعرض إلى تعريف الحق في الخصوصية في الشريعة الإسلامية، إذ أن تعاليم الدين الإسلامي قد حافظت على خصوصية الإنسان وذلك بتجريم الاطلاع على عورات الإنسان وتجريمها للسرقة والدخول للمسكن والتجسس أيضا، حيث اعتبرت الشريعة الإسلامية احترام الحياة الخاصة للإنسان من أهم الحقوق، حيث حرصت على حمايتها وكفائتها، ولكن حماية هذا الحق ليس مطلقا وإنما ترد عليه استثناءات تقضي بإباحة المساس بهذا الحق لتحقيق مصلحة المجتمع، وقد تبين أن الحق في الخصوصية الجينية يتمثل في حق الشخص في أن يقرر لذاته المعلومات التي يمكن للغير معرفتها عن نفسه والذي يتكون من عنصرين متمثلين في الأول: الحق في عدم المعرفة والثاني: هو الذاتية، وأن محل الحق في الخصوصية الجينية هو المعلومات التي يرغب الشخص في إخفائها عن الغير والمتحصلة من الاختبارات الجينية أو الفحص الجيني وذلك نظرا لخطورة هذه المعلومات إذ إنها لصيقة بالشخص ذاته، كما تبين أن هناك جوانب إيجابية وكذا جوانب سلبية تتعلق بطبيعة الحق في خصوصية الجينات الوراثية، فبالنسبة للجوانب الإيجابية فإن الفحص الجيني مباح ولكن قام الفقهاء بوضع عدة ضوابط شرعية له مثل اقتصار إجراء الفحص الجيني على الخلايا الجسدية فقط دون الخلايا التناسلية وكذا عدم وجود أضرار محتملة قد تلحق بشخص القائم بالفحص الجيني وكذا مراعاة أحكام الشريعة الإسلامية فيما يتعلق بكشف عورة المريض وكذا إفشاء نتائج الفحص الجيني وذلك حفاظا على الخصوصية مع إباحة حالات يتم فيها الكشف عن هذه المعلومات للغير وذلك في حالات الضرورة وذلك حفاظا على مصلحة المجتمع، وبالنسبة للجوانب السلبية تتمثل في إمكانية التمييز بين الأشخاص في مجال التأمين والعمل وكذا في مجال التعليم وفي مجال الإخصاب الصناعي وقد تبين أن المتفق عليه بشأن إجراء الفحص الجيني للخلايا الجينية محظور شرعا.

Also, it has great importance in determining the genetic characteristics of a person, as well as predicting diseases that may affect humans in the future, as well as identifying the perpetrators of crimes and establishing the lineage as well, through examination. Genetic footprint. The definition of the right to privacy was also covered in Islamic law, as the teachings of the Islamic religion preserved human privacy by criminalizing access to human nudity and criminalizing theft, entering the home and espionage as well.. I have to protect it and its efficiency, but protecting this right is not absolute. Instead, exceptions are made to it requiring permission to violate this right in order to achieve the benefit of society. The first: the right not to know, and the second: subjectivity, and the place of the right to genetic privacy is the information that a person wishes to hide from others that he obtained from genetic tests or genetic tests, due to the seriousness of this. This information as it relates to the same person, as it turns out that there are positive aspects in addition to negative aspects related to the nature of the right to the privacy of genetics, as for the positive aspects, it is permissible to conduct genetic testing, but the jurists have set several legal controls for it, such as restriction after genetic examination on Body cells only, excluding reproductive cells, as well as the absence of potential harm to the person who conducts the genetic examination, as well as observing the provisions of Islamic law regarding the detection of the patient's nudity, as well as the disclosure of the results of the genetic examination in order to preserve privacy while allowing cases in which there is nudity. It is the information that is disclosed to others in cases of necessity in order to preserve the interest of society. As for the negatives, it is the possibility of distinguishing between persons in the field of insurance and work, as well as in the field of education and in the field of industrial fertilization.
