|a يعد التعويض من الضمانات القانونية التي توفر حماية لملكية المستثمر الأجنبي من المخاطر التي قد تصيبه خلال عملية الاستثمار، خاصة تلك المتعلقة بالإجراءات الانفرادية التي قد تمارسها الدولة المضيفة في إطار سيادتها الوطنية كنزع الملكية، المصادرة، التأميم، وكذا الإجراءات التمييزية؛ إذ يعتبر التعويض حق لا خلاف حول مشروعيته حسب ما أقره مبدأ الحقوق المكتسبة وكذا مبدأ الإثراء بلا سبب، إضافة إلى مبدأ المسؤولية العقدية، كما يعترف بإلزاميته دوليا وفق ما تم إقراره في معظم التوصيات والمواثيق الدولية الصادرة عن الهيئات والمنظمات الدولية، وكذا في مختلف الاتفاقيات الجماعية أو الثنائية التي تلعب دورا هاما في هذا المجال، نظرا لما تتضمنه من تفاصيل خاصة بقواعد التعويض كشروطه وتقديره وحتى طريقة دفعه، بغية ضمان حماية مال المستثمر الأجنبي.
