المستخلص: يتناول البحث دراسة مسألة خيار المجلس دراسة شاملة، ويدور البحث حول إجابة السؤال: هل التفرق المذكور في حديث ابن عمر مقصود به التفرق بالأقوال، أم بالأبدان؟ بمعنى هل البيع يتم بالتفرق بالكلام وهو العقد من الإيجاب والقبول؟ أو يشترط التفرق بالأبدان؟ وهذه المسألة هي محل النزاع. وقد تناول البحث تخريج حديث ابن عمر من مظانه الحديثية؛ بأن ذكر طرق الحديث، وتوابعه، وشواهده، وجمعها في محل واحد. وقد تعرض البحث لبيان معاني أهم ألفاظ الحديث لغويا، مع ضبط الألفاظ، وترجع أهمية ذكر المعاني اللغوية لما يترتب على المدلولات اللغوية من أثر في الخلاف الفقهي في فهم الحديث. وقد بين البحث أن الفقهاء قد اختلفوا في فهم الحديث والقول بخيار المجلس على فريقين، والفريق الأول ذهب إلى أن التفرق المقصود في الحديث هو التفرق بالأقوال، واستدلوا على قولهم بأدلة، وأكثروا من الاعتراض على أصحاب القول الثاني. وأما الفريق الثاني فذهبوا إلى أن التفرق المقصود في الحديث هو التفرق بالأبدان، وكانت لهم أدلتهم، وردود على اعتراضات الفريق الأول من الفقهاء. وقد عرض البحث لأقوال الفريقين في خيار المجلس، كل ذلك في سياق علمي قائم على سبر الطرق، وجمع الشواهد، وذكر الأدلة من مصادرها الأصلية، وعرض الرأي والرأي الآخر، مع النقل عن الأئمة المتقدمين والفقهاء في مظان المسألة من كتب الحديث الشريف وكتب الفقه وأدلة الأحكام، وتم هذا بحيادية تامة، وقد ترجح بعد البحث والمناقشة أن القول بثبوت خيار المجلس، وحمل التفرق في الحديث على التفرق بالأبدان هو القول الصحيح. وقد اجتهدت في جمع النصوص المتعلقة بالمسألة، وترتيب المعلومات، مع التسلسل والمنطقية في الصياغة. وحسبي أن أكون خادمة لكتب المتقدمين، ويستطيع من يهتم بمسألة خيار المجلس وأقوال الفقهاء أن يجد بغيته على أكمل وجه، والكمال لله وحده في هذا البحث الحديثي الفقهي المقارن. وصلى الله على سيدنا محمد وآله وصحبه وسلم.

The study deals with the study of the question of the Council's option. A comprehensive study is conducted on the answer to the question: Is the difference mentioned in the hadeeth of Ibn 'Umar intended to differentiate between words, or in Abadan? In other words, is the sale to be dispersed by words, which is the contract of affirmation and acceptance? Or is it necessary to differentiate between the two? This issue is the subject of dispute. The research dealt with the graduation of the hadeeth of Ibn 'Umar from its modern madhhabs, by mentioning the ways of the hadeeth, its ramifications, and its evidences, and collecting them in one place. The research has been presented to explain the meanings of the most modern words linguistically, with the control of the words, and the importance of mentioning the meanings of the linguistic implications of the linguistic implications of the difference in jurisprudence in the understanding of modern. The research has shown that the scholars differed in understanding the hadeeth and saying the choice of the council over two groups. The first group went on to say that, the difference in the hadeeth is to differentiate between the words, and they are quoted as evidence. As for the second group, they said that the difference in the hadeeth is to differentiate between two parts of the hadeeth, and they have their evidence and answers to the objections of the first group of futqaha. The research presented the statements of the two groups in the Council's option, all in a scientific context based on exploring roads, collecting evidence, citing evidence from their original sources, and presenting the opinion and opinion of the other, with the transfer of the imams and scholars in the case of the Hadith, , And this was done with absolute neutrality. It is likely that after the research and discussion, the statement of the choice of the Council, and the fact that the difference in the hadeeth is based on the distinction between the two sides is correct. It has endeavored to collect texts on the issue and to arrange information, with sequencing and logical formulation. And I can be concerned with the question of the choice of the Council and the sayings of the scholars to find the fullest, and perfection of God alone in this modern comparative jurisprudence research.
