المستخلص: من مقاصد الشريعة وأصول الإسلام وحدة الكلمة والائتلاف، وعدم التفرق والاختلاف حيث جاءت نصوص الكتاب والسنة آمرة بالاعتصام بحبل الله، وناهية عن التفرق، وموضوع الاختلاف بين الفقهاء وأثره في ترسيخ الأمن الفكري من المواضيع التي لها أهمية كبيرة وخاصة في هذا العصر الذي انتشر فيه الاختلاف بين الناس بمستويات مختلفة وأساليب متعددة، واختلط فيه المفهوم الحقيقي للاختلاف بين الفقهاء بغيره من المفاهيم الأخرى؛ لأن الاختلاف وإن كان مذموما في حقيقته، إلا أن ذمه لا يعني ذم المختلفين بكل حال؛ لأن يوجد نوع من الاختلاف له مبرراته ومسوغاته التي تقتضي وقوعه، فلزم بيان ذلك إنارة للعقول وحماية لأفكار شباب الأمة من المفاهيم المنحرفة والطرق الملتوية في فهم النصوص وتزيلها على الوقائع والأحداث. فجاءت هذه الدراسة مشتملة على بيان مفهوم الاختلاف بين الفقهاء وأنواعه وأسبابه، وقواعده وضوابطه، ثم وسائل علاجه والآداب التي ينبغي أن يتحلى بها المختلفون، والمقصد الشرعي من تحقيق جمع الكلمة والائتلاف وعدم التفرق والاختلاف، وأثر الاختلاف بين الفقهاء في ترسيخ الأمن الفكري والسلم المجتمعي. ثم ختم البحث بأهم النتائج والتوصيات.

This study included a statement of the concept of the difference between jurists, its types and causes, rules and controls, then methods of treatment and morals that should be demonstrated by the different, and the legitimate purpose of achieving the word gathering and the coalition and the lack of distinction and difference, and the effect of the difference between the jurists in the consolidation of intellectual security and societal peace. Then the research concluded with the most important results and recommendations.
