المستخلص: تعالج هذه الدراسة موضوع الوسطية في المعاملات في ضوء آية: (مِنْ أَوْسَطِ مَا تُطْعِمُونَ أَهْلِيكُمْ) وتناقش التباين في الأصل الذي ينبني فيه توجه كل مذهب لفهم الآية. والهدف ربط الوسطية بالحكم الشرعي ومعرفة ضوابطها وحدودها؛ خاصة أن بعض الخلاف يدور حول كون الكفارة معينة من الشارع أو غير معينة، وجعلها هذه القيمة المهمة واضحة لا غموض فيها، وإظهار ذلك ضرورة لازمة لاستكمال خاصية الوسطية في الأمة التي أثبتها لها القرآن الكريم. وقد تم تقسيم الدراسة إلى مباحث فاحتوى المبحث الأول على توطئة لغوية في معنى الأوسط، بينما احتوى المبحث الثاني على مسألة الأوسط في الإطعام في كفارة اليمين، ومفهوم الوسطية في المعاملات. وخلصت الدراسة إلى أن الوسطية بمفهومها الشامل لا يتأتى تعريفها بقيود معينة تتعارض مع شمولها، ومراعاتها في شئون الحياة كاملة. وأنها في باب المعاملات (الكفارة) أمر يتعلق بالاعتدال في الأداء مراعاة لمصالح المكلفين، فالواقعية في الوسطية مدارها نفع الطرفين معا المكفر والمحتاج، وقد يزيد ذلك انضباطا تدخل ولي الأمر في تقنينه بحسب عرف البلد الذي هو فيه، وذلك كله من ثمار الوسطية الصحيحة القائمة على العدل والتوازن، الباعثة على التآخي والسلام. وكل ذلك يؤكد أن أحكام الكفارة تنطلق من فعل الفرد إلى حاجة الجماعة، والوسطية توجه ذلك وتحققه على وجهه الأعدل والأكمل.

This study deals with the issue of moderation in transactions in the light of the noble verse: (on a scale of the average for the food of your families). T discusses the discrepancy in the origin in which each school of thought is based on understanding the verse. The goal is to link moderation to Shariah rule and to know its controls and limits; Especially since some controversy revolves around whether the penance is specific to the lawgiver or not, and making it this important value clear and unambiguous, and showing this is a necessary necessity to complete the characteristic of moderation in the nation that the Holy Qur'an established for it. The study was divided into sections. The first topic contained a linguistic introduction to the meaning of the middle, while the second topic contained the question of the middle in penance the right at expiation, and the concept of penance in transactions. The study concluded that moderation in its comprehensive concept cannot be defined by certain restrictions that contradict its comprehensiveness and its observance in all life affairs. And that it is in the section of transactions (penance) a matter related to penance in performance taking into account the interests of the taxpayer, for realism in penance revolves around the benefit of the two parties together, the infidel and the needy, and this may increase the discipline of the guardian's intervention in its regulation according to the custom of the country in which he is, and all of this is from the fruits of correct penance based on Justice and balance, conducive to brotherhood and peace. All of this confirms that the provisions of penance stem from the individual's action to the group's need, and penance helps to achieve this in the most complete form.
