المستخلص: لقد أولت المملكة العربية السعودية اهتماما كبيرا بحقوق المؤلفين حفاظا على الإنتاج الفكري للمبدعين في المملكة العربية السعودية، ولذلك فقد انضمت المملكة العربية السعودية إلى الاتفاقات الدولية لحماية المؤلفين، كما أن المنظم السعودي أولى عناية واهتمام بحق المؤلف والحقوق المجاورة وذلك من خلال النص على عقوبات صارمة في نظام حماية حق المؤلف، وما هذا إلا تشجيع وحماية من جانب المنظم للمبدعين والمؤلفين والمبتكرين. إلا أنه يجب الأخذ في الاعتبار أن الفائدة التي يحصل عليها المؤلف من تلك الحماية قد تتسبب في كثير من الأحيان في حرمان الآخرين منها وهو ما لا يتناسب والمصلحة العامة التي تهدف إلى الاستفادة القصوى من إبداعات المؤلفين؛ ولتحقيق موازنة موضوعية بين حقوق المؤلف ورغبة الجمهور بالانتفاع من المؤلفات، فقد تم وضع الأنظمة المنظمة لذلك الأمر. وتتناول الدراسة الحالية موضوع الحماية الجنائية لحقوق المؤلفين في المملكة العربية السعودية، وهو موضوع مهم وضروري للمبدعين في كافة المجالات داخل المملكة. وترجع أهمية الدراسة لكون الحماية الجنائية للإنتاج الفكري يمثل عنصر مهم وأساسي للتطور العلمي والاقتصادي والسياسي والاجتماعي، وهو الأمر الذي يشجع المبدعين على مواصلة الإبداع والتميز؛ كما تكتسب هذه الدراسة أهمية أخرى من ناحية الوعي المعرفي لدى الكثيرين والإدراك للحماية الجنائية لحق المؤلف والحقوق المجاورة في المملكة العربية السعودية.

The Kingdom of Saudi Arabia has paid great attention to the rights of authors to preserve the intellectual production of creators in the Kingdom of Saudi Arabia. Therefore, the Kingdom of Saudi Arabia has joined the international agreements to protect authors, and the Saudi regulator has paid attention and attention to copyright and related rights by stipulating strict penalties in Copyright protection system, and this is nothing but encouragement and protection by the regulator for creators, authors, and innovators. However, it must be considered that the benefit that the author obtains from this protection may often cause others to be deprived of it, which is not commensurate with the public interest that aims to make the most of the authors' creations; To achieve an objective balance between copyright rights and the public's desire to benefit from the literature, the regulations governing this matter have been established. The current study deals with the issue of criminal protection for the rights of authors in the Kingdom of Saudi Arabia, which is an important and necessary topic for creators in all fields within the Kingdom. The importance of the study is due to the fact that criminal protection for intellectual production is an important and essential element for scientific, economic, political and social development, which encourages creators to pursue creativity and excellence; This study also acquires another importance in terms of the cognitive awareness of many and the awareness of the criminal protection of copyright and related rights in the Kingdom of Saudi Arabia.
