المستخلص: اقتصر هذا البحث على دراسة المقاصد التحسينية في كتاب الوصايا دراسة تطبيقية، وجاء في مقدمة وثلاثة مباحث وخاتمة، وتضمن المبحث الأول التعريف بالمقاصد التحسينية من خلال تعريف المقاصد التحسينية، وأقسامها، ومكملاتها، وطرق معرفتها، وتمييزها عن المقاصد الحاجية، وتضمن المبحث الثاني التعريف بالوصايا والأخلاق، من خلال التصور التام للوصية، وبيان خصائص الأخلاق في الشريعة الإسلامية، ثم كان المبحث الثالث وفيه دراسة تطبيقية للمقاصد التحسينية في كتاب الوصايا وفيه ستة مطالب، ونهجت في البحث المنهج الاستقرائي التحليلي، حيث تم استقراء مواطن المقاصد التحسينية في باب الوصايا من مظانها، ثم الوقوف على أقوال أهل العلم التي تظهر المقاصد التحسينية في باب الوصايا، وتطبيقها على المسائل المبحوثة، وجاءت الخاتمة متضمنة أهم النتائج والتوصيات التي كشفت عنها الدراسة، أن تنزيل المقاصد التحسينية على حالات جزئية وخاصة يتطلب مزيدا من النظر والتحديد، وهذا يستدعي بدوره مزيدا من البحث والدراسة لفهم طبيعة وآليات الفعل الفردي والتفاعل الجماعي، وذلك في ضوء الاعتماد على بعض القواعد والأعراف الاجتماعية التي ينبغي الاعتداد بها في تشغيل القواعد الأصولية، وتطبيق الأحكام الشرعية التحسينية بناء على قاعدة "المعروف عرفا كالمشروط شرطا"، وأن التقصيد الجزئي خادم للمكلفين، وآخذ بيدهم في طريق التعبد السليم، فمن أدرك المقاصد الجزئية صان نفسه عن الممارسة الصورية الفجة للشعائر والأحكام، وعبد الله على بصيرة، وذاق من حلاوة عبادته ما يزيده شدا على حبل الدين، واستزاد من الطاعة وذلك من أعظم الخيرات، وكذلك لابد من الكتابة في موسوعة للمقاصد الجزئية ترتب على الأبواب الفقهية المعروفة، وكذلك إنجاز بحوث عن التقصيد النوعي تعني بمساره التاريخي وضوابطه ووظائفه، فما زال علم المقاصد يحتاج إلى مزيد من البحث العلمي.

This study is limitedly concerned with improvement objectives in the book entitled ‘Al-Wasaya (Wills): An Applied Study’. It consists of an introduction, three sections and a conclusion. In the first section, a definition of improvement objectives is provided by explaining its, types and complementary aspects, methods of identification and distinction when compared to requirement objectives. The second section has shed light on definition of wills and ethics through full perception of will and characteristics of ethics in Islamic Shariah. The third section is an applied study to the improvement objectives in the book entitled ‘Al-Wasaya’ or (Wills) through six subtitles. To this aim, the researcher has employed the analytical inductive methodology where the aspects of improvement purposes have been induced in the Chapter entitled ‘Al-Wasaya’. Afterwards, quotations of the scholars highlighting the improvement objectives have been recognized and applied to the issues- subject to investigation. Eventually, a conclusion of the study has referred to the most significant findings and recommendations. First, improvement objectives applied to partial and special cases require more consideration and further identification- a matter that would in turn need further study to comprehend the nature and mechanism of individual vs. societal interaction in the light of having a number of social customs and traditions. This will be duly observed when applying the fundamental rules and improved provisions of Islamic Shariah given the rule of ‘what is known by custom is as a condition,. Partial intention is deemed a tool serving those charged ‘mukalafin’, leading them on the path of proper worship. Hence, whosoever realizes partial objectives will protect himself from the crude shameful practice of rituals and rulings, and worship ALLAH with insightfulness, and then he/ she will taste the sweetness of his worship that adds to his Religion increased obedience and this is one of the greatest good deeds. Moreover, it is recommended that scholars write in an encyclopedia of partial objectives arranged in alignment with known jurisprudential chapters. Also, there should be research on qualitative objective concerned with its historical course, its constraints and functions as the discipline concerned with Shariah Purposes and objectives is still in need of further academic research and studies.
