المستخلص: اذا كان الرصيف-وهو الجزء الخاص بالمارة من الشارع، المتموضع كممر على طول جانبيه وفقا لمعايير تخطيطية وهندسية، والذي يعمل على فصل حركة المشاة عن حركة المركبات، ليحد من التداخل بين حركتيهما، فيوفر مساحة آمنة للمشاة، فضلا عما يوفره من خدمة لأغراض أخرى-عقارا مملوكا للبلدية ملكية عامة مرصودة للنفع العام، فان فضاء الرصيف سيكون مملوكا للبلدية ومخصصا للنفع العام، تبعا لأصله (أرض الرصيف)، باعتبار أن ملكية الأرض تشمل ما فوقها علوا إلى الحد المفيد، كما تقرر القواعد العامة وفضاء الرصيف هو الفراغ المطابق مساحة لحدود ارض الرصيف والممتد منها علوا، والذي ينتهي منه نفع البلدية عند الحد الذي يتعدى اللازم للرصيف لأداء وظائفه المقررة تجاه مستخدميه. وبانتهاء الانتفاع الفعلي للمالك (البلدية) من فضاء ملكه (الرصيف) يبدأ انتفاعها بالقوة، ليسمح لها القانون ببيع الفضاء الكائن فوق أرصفة الشوارع لملاك العقارات المطلة والملاصقة للأرصفة لغرض استغلاله بالبناء الممتد من الطوابق العلوية من مباني عقاراتهم فتتسع مساحة فوق الرصيف. وليشكل ذلك تسقيفا للرصيف كاستغلالا قانونيا لفضائه بالشراء الموثق في سجلات التسجيل العقاري بأسماء أولئك الملاك، وفي ذلك نفع لجميع الأطراف؛ من بلدية وملاك ومستخدمي الرصيف بيد أن التنظيم القانوني لتسقيف الرصيف يثير في بعض أحكامه شجونا بنيوية قانونية، ورؤى لم يلحظها مشرعها أو لاحظها باختلاف، وهو ما سعينا في البحث لمحاولة الولوج فيه في محاكمة مختصرة نقيمها لنصوصه لنشخص عيبه ونوصف له علاجا من القانون نراه.

With the end of the actual use of the owner (the municipality) from the space of his property (the sidewalk), its use begins by force, so that the law allows it to sell the space on the sidewalks of the streets to the owners of the properties overlooking and adjacent to the sidewalks for the purpose of using it in the building extending from the upper floors of their property buildings to expand the area above the sidewalk. So that this constitutes a roof over the sidewalk as a legal exploitation of its space by purchasing that is documented in the real estate registry records in the names of those owners, and that is beneficial to all parties.From the municipality, owners and users of the dock. However, the legal regulation of pavement roofing raises in some of its provisions legal structural arguments, and visions that its legislator did not notice or noticed in a different way, and this is what we sought in the research to try to access it in a brief trial that we evaluate for its texts to diagnose its defect and prescribe to him a remedy from the law we see.
