المستخلص: In general, the majority of suicides occur as a result of a person losing his will due to mental illness, eligibility symptoms, abuse, or others, but the suicide process may sometimes occur by the person's own will and awareness. The issue of suicide aroused our interest from the legal side to research it and find out how the suicide insurance contract is dealt with, in particular whether there are special laws related to suicide insurance, or whether it’s considered within the rules of insurance for people in the event of death. We encountered several difficulties related to the subject of the research represented in the lack of legislative regulation regarding the suicide insurance contract, and we did not find judicial precedents related to this matter, which raised the question about the extent to which a person can conclude a suicide insurance contract if the act of suicide was made by choice and by free will. In the research, we will try to answer this question and show the validity of concluding a suicide insurance contract and the conditions to be met in a suicide insurance contract by analyzing the legal texts related to the general rules of insurance for the case of death in Iraqi legislation and comparing these provisions with a part of the Arab legislation that dealt with this type of insurance. Accordingly, our study will be divided into two sections. In the first section, we will deal with the nature of the insurance contract. In the second section, we will study the specificity of the insurance contract against suicide with regard to the obligations of the two parties, especially the obligation of the insured party to pay the premium, and the obligation of the insuring party to pay compensation, leaving the rest of the topics related to the general rules of the life insurance contract so as not to repeat the research on the same topic.
