المستخلص: عهد المشرع الكويتي لجهاز الشرطة بتحقيق الأمن العام والخاص للمجتمع ومن يعيش في كنفه من براثن الجريمة والمجرمين والعمل على صدهم ومنعهم من ارتكاب الجريمة ومكافحة ذلك، وضبطهم في حال وقوعها واتخاذ الإجراءات المتبعة بالتعاون مع السلطات الأخرى المعنية بهدف حماية النظام المجتمعي السائد وتحقيق ديمومته والذي بطبيعة الحال ينعكس على تأمين سلامة وأمن أفراده وأمانهم من تلك الجرائم. ويتم تنفيذ الواجبات المكلف بها جهاز الشرطة من خلال عناصره الأمنية من ضباط وضباط صف وأفراد ومعاونيهم، والذين يشهدون من خلال تنفيذهم للأعمال الأمنية الموكلة لهم وقوع العديد من الجرائم المشهودة من جنايات وجنح أمام أعينهم وتحت بصرهم، وهو الأمر الذي دفع للقيام بهذه الدراسة البحثية، فقد تم تقسيم الدراسة إلى ثلاثة مباحث، في المبحث الأول تم تناول تعريف الجريمة المشهودة وحالاتها، أما المبحث الثاني فيتناول شروط صحة الجريمة المشهودة، ويتناول المبحث الثالث صلاحيات رجال الشرطة في حال الجريمة المشهودة. وتوصل الباحث في نهاية البحث إلى مجموعة من النتائج والتوصيات، كانت أهم نتيجة بأن الجريمة المشهودة هي وصف على الجريمة ذاتها وليست فاعلها فيمكن مشاهدة الجريمة دون مشاهدة فاعلها ويكاد يكون الزمن فيها منعدم، وكانت التوصية الأهم بأنه يتوجب على رجال الشرطة عدم التوسع في القياس بأن الجريمة التي قاموا بضبطها هي جريمة مشهودة بهدف أن يستخدموا ويستغلوا الصلاحيات الممنوحة لهم في مثل هذه الجرائم، فالأصل بأن رجال الشرطة مؤتمن على حماية الحقوق والحريات الشخصية للأفراد وغيرهم من الأشخاص والكيانات القائمة دخل الدولة بل وقد أقسم على ذلك قبل مباشرته لأعمال الوظيفية الشرطية.

The Kuwaiti legislator entrusted the police force with the achievement of public and private security for the community and those who live in including crime tentacles and criminals. As well, it has been entrusted with combating the crime and repel criminals and prevent them from committing crimes, arresting them if they committed a crime, and taking the measures required in cooperation with other concerned authorities aiming to protect the prevailing societal system and achieve its sustainability, which, of course, shall be reflected in ensuring the safety and security of its members and their safety from such crimes. The duties entrusted to the police force are carried out through its security elements, including officers, non-commissioned officers, individuals and their assistants, who attend, through the implementation of the security work entrusted to them, the occurrence of many flagrant crimes such as felonies and misdemeanors before their eyes. That’s why we conduct this research study. The study is divided into three themes. The first theme deals with the definition of the flagrant crime and its cases. The second theme deals with the conditions for the validity of the flagrant crime. The third theme deals with the powers of the policemen in the case of the flagrant crime. Finally, the researcher reaches a set of results and recommendations. The most important result is that the flagrant crime is a description of the crime itself and not a description of its perpetrator; It is possible to see the crime without seeing the perpetrator, the time is almost non-existent. The most important recommendation is that the policemen should not expand on the analogy that the crime they have seized is a flagrant crime aiming to use and exploit the powers granted to them in such crimes. The principle is that the policeman is entrusted with the protection of the personal rights and freedoms of individuals and other persons and entities in the state. Even the policeman took an oath to do so before assuming the duties of a police position.
