|a تعتبر المسؤولية الطبية وأخطاء الأطباء ضمن الموضوعات التي لازمت ممارسة الطب منذ القدم، حيث كان الطب بدائيا، غير أنه مع تقدم الطب الكبير في هذا العصر واتساع آفاقه، حيث حقق إيجابيات وفوائد عديدة للبشرية، ومما لا شك فيه أن موضوع المسؤولية الجنائية للأعمال الطبية يعد من أكبر الموضوعات التي أثيرت منذ عهد بعيد. تبرز أهمية موضوع المسؤولية الجنائية عن الأخطاء الطبية بسبب تفاقم هذه الظاهرة في الفترة الأخيرة، فأصبحت تشكل خطرا على كل من أراد اللجوء للطبيب، مما أثار الجدل حول ما تثيره هذه المسؤولية من مسائل قانونية، حيث تهدف هذه الدراسة إلى بيان أوجه القصور التي سجلها قانون العقوبات، بسبب عدم نصوص خاصة تنظم هذه المسؤولية، وكذا تحديد المسؤولية الجنائية للطبيب في قانون العقوبات وفق المواد 288 و 289 و 2/442 من قانون العقوبات الجزائري وكذلك في قانون الصحة.
|b Medical liability and physician errors are among the subjects that have accompanied the practice of medicine since it was rudimentary. However, with the great progress of medicine nowadays and the development of its prospects, it has acquired different advantages and benefits for mankind. Thus, criminal liability for medical work is undeniably one of the most important issues raised for ages. The criminal liability that results from medical errors is of great importance, due to the worsening of this phenomenon in recent times, posing a risk for all those who would want to consult a doctor, which raises the debate on the legal questions raised by this responsibility. The purpose of this study is to highlight the restrictions recorded by the penal code due to the absence of specific texts governing this responsibility and determining the penal responsibility of the doctor relating to crimes; in particular those stipulated in articles 288, 289 and 442/ 2 of the penal code and the Law on health.
