المستخلص: في ظرف من الظروف، قد يغيب إنسان عن أهله وينقطع خبره، فلا نعلم أحي هو أم ميت، وبالتالي يترتب على ذلك أحكام تتعلق بماله أو زوجه، على الناس أن يدركوها ويتعلموها. وفي هذا البحث يبين الباحث المعنى الدقيق للمفقود، ثم يبحث في المدة المنتظرة للحكم بموت المفقود، وهل هي مقدرة بمدة زمنية محددة أم أنها تعود لرأي القاضي واجتهاده حسب ما يراه الأصلح والأقرب للصواب، وذكر خلاف الفقهاء في ذلك والتوصل للرأي الراجح. ثم يتناول الباحث بيان حكم المفقود خلال فترة التربص وقبل الحكم بموته قضاء، باجتهاد القاضي أو بالتحديد بالسن، هل يعتبر المفقود حيا في حق نفسه وفي حق غيره، فلا تعتد زوجته ولا يقسم ماله، ويرث من غيره، أو يعتبر ميتا في شيء دون شيء. ثم يذكر الباحث أثر ظهور المفقود وعودته إلى أهله بعد الحكم بموته، وذلك فيما يتعلق بزوجته، التي تكون قد تزوجت من رجل آخر، وفيما يتعلق بأمواله، التي تقاسمها ورثة المفقود، والتي قد تكون باقية أو صرفت وهلكت. ولا ينسى الباحث مقارنة ذلك كله مع ما جاء في القانون السوري، وما ارتبط بواقع الحياة.

In a circumstance, a person may be absent from his family and his news is cut off. We do not know whether he is alive or dead, and in general, there are many standards to his money or his wife's money, which people must realize and learn In this abstract, the researcher presents the exact meaning of the absence then looks at the Iddah period and to realize the death of the absence, and whether it is estimated for a specific or it is related to the judge's view or jurisprudence according to what he sees fittest and closest to the truth. Then the researcher searches for the statement of the absence. Person’s ruling during the period of waiting and before the judgment of his death is judged, according to the judge’s view, or specifically by age. Is the absent person considered alive according to himself and for others, so his wife doesn't have Iddah and his money is not divided, and he inherits from others, or is he considered dead in something without anything Then the researcher mentions the impact of the return of the missing person and to his family after his death judgment, regarding to his wife, who may have married another man, and his money, which was shared by the heirs of the missing person, which may be remaining or spent. The researcher does not forget to compare all this with what was stated in the Syrian law, and what is related to the reality of life.
