|a فالتنفيذ الجبري للأحكام وباقي السندات التنفيذية يشكل نهاية المراحل الطويلة للنزاعات أمام القضاء وهي المرحلة التي يحصل فيها الدائن على حقه، ويضع حدا لتعنت مدينه فيشعر بثقة في مؤسسات الدولة فيأمن على ماله وحريته وشرفه. وفي المقابل يشكل للمدين عبرة على عدم وفائه بالتزامه، وأن السلطة العامة لن يمنعها عناده من ضمان الوفاء قهرا عنه وبأمواله المنقولة أو العقارية، لأن توفير العدل وحماية أموال الناس من صميم مهام ومسؤوليات الدولة. ونظرا لما لإجراءات التنفيذ من أهمية فمن الطبيعي أن يوليه الأطراف أهمية كبيرة بتوفير جميع الوسائل لتطبيقه، كما أن الجهات المسؤولة والأجهزة الموكول لها السهر على هذه الإجراءات توليه بعناية خاصة وهو ما يفرض مواجهة الصعوبات التي تعترضه وكل ذلك سنتعرض له عند مناقشة الموضوع.
|b The execution of the judgments and the rest of the executive bonds constitutes the end of the long stages in judiciar procedure, and it is the stage in which the creditor obtains his right, puts an end to the intransigence of his debtor, so that he feels confidence in the institutions of the state, so that he is secure in his money, freedom and honor. On the other hand, it constitutes for the debtor an example of his failure to fulfill his obligation, and that the public authority will not prevent it from his stubbornness from guaranteeing the payment by compulsion on his behalf and with his movable or real property, because providing justice and protecting people’s money is at the core of the tasks and responsibilities of the state. Given the importance of the execution procedures, it is natural for the parties to attach great importance to providing all means to implement it, and the responsible authorities and agencies entrusted with the supervision of these procedures take it with special care, which necessitates facing the difficulties it faces, and all of this we will address when discussing the subject.
