|a اشتمل القانون الدولي الإنساني ضمانات أساسية تستهدف حماية بعض فئات من الأشخاص، كأفراد الخدمات الطبية وحماية بعض الأعيان المدنية ومبدأ حماية البيئة الطبيعية؛ بحماية خاصة أثناء النزاعات المسلحة الدولية أو غير الدولية. وقد جاءت هذه الدراسة لتبيان ما مدى الحماية القانونية الخاصة التي أولاها القانون الدولي الإنساني لأفراد الخدمات والبعثات الطبية وكذا الحماية القانونية للأشخاص المشاركون في عمليات حفظ السلام (كمبحث أول)، كما نتساءل عن مدى الحماية القانونية الخاصة التي كفلها القانون الدولي الإنساني للممتلكات الثقافية بمختلف أصنافها وحماية البيئة الطبيعية أثناء النزاعات المسلحة (كمبحث ثاني). وللإجابة عن هذه الإشكالية، فقد سلكنا منهج تحليلي، وقفنا عبره على تحليل أحكام وقواعد القانون الدولي الإنساني المتصلة بموضوع بحثنا، كما قمنا بتبيان بعض الأحكام القضائية والآراء الفقهية وتحليلهما، للوقوف حول جدية قواعد القانون الدولي الإنساني في وضع حماية قانونية خاصة لهذه الفئات من الأشخاص وهذه الأعيان الثقافية والبيئة الطبيعية.
|b International humanitarian law includes basic guarantees aimed at protecting certain categories of persons, such as medical personnel, protection of some civilian objects, and the principle of protecting the natural environment. With special protection during international or non-international armed conflicts. This study came to show the extent of the special legal protection that international humanitarian law has assigned to the personnel of medical services and missions, as well as the legal protection for people participating in peace-keeping operations (as a first study). We also ask about the extent of the special legal protection that international humanitarian law has guaranteed for cultural property of all kinds and the protection of The natural environment during armed conflicts (as a second topic). To answer this problem, we took an analytical approach, through which we analyzed the provisions and rules of international humanitarian law related to the subject of our research, and we also clarified and analyzed some judicial rulings and jurisprudential opinions, to stand on the seriousness of the rules of international humanitarian law in the development of special legal protection for these groups of persons These are the cultural objects and the natural environment.
